In September 2010 and February 2011 the Canterbury region of New Zealand was struck by two powerful earthquakes, registering magnitude 7.1 and 6.3 respectively on the Richter scale. The second earthquake was centred 10 kilometres south-east of the centre of Christchurch (the region’s capital and New Zealand’s third most populous urban area, with approximately 360,000 residents) at a depth of five kilometres. 185 people were killed, making it the second deadliest natural disaster in New Zealand’s history. (66 people were killed in the collapse of one building alone, the six-storey Canterbury Television building.) The earthquake occurred during the lunch hour, increasing the number of people killed on footpaths and in buses and cars by falling debris. In addition to the loss of life, the earthquake caused catastrophic damage to both land and buildings in Christchurch, particularly in the central business district. Many commercial and residential buildings collapsed in the tremors; others were damaged through soil liquefaction and surface flooding. Over 1,000 buildings in the central business district were eventually demolished because of safety concerns, and an estimated 70,000 people had to leave the city after the earthquakes because their homes were uninhabitable. The New Zealand Government declared a state of national emergency, which stayed in force for ten weeks. In 2014 the Government estimated that the rebuild process would cost NZ$40 billion (approximately US$27.3 billion, a cost equivalent to 17% of New Zealand’s annual GDP). Economists now estimate it could take the New Zealand economy between 50 and 100 years to recover. The earthquakes generated tens of thousands of insurance claims, both against private home insurance companies and against the New Zealand Earthquake Commission, a government-owned statutory body which provides primary natural disaster insurance to residential property owners in New Zealand. These ranged from claims for hundreds of millions of dollars concerning the local port and university to much smaller claims in respect of the thousands of residential homes damaged. Many of these insurance claims resulted in civil proceedings, caused by disputes about policy cover, the extent of the damage and the cost and/or methodology of repairs, as well as failures in communication and delays caused by the overwhelming number of claims. Disputes were complicated by the fact that the Earthquake Commission provides primary insurance cover up to a monetary cap, with any additional costs to be met by the property owner’s private insurer. Litigation funders and non-lawyer claims advocates who took a percentage of any insurance proceeds also soon became involved. These two factors increased the number of parties involved in any given claim and introduced further obstacles to resolution. Resolving these disputes both efficiently and fairly was (and remains) central to the rebuild process. This created an unprecedented challenge for the justice system in Christchurch (and New Zealand), exacerbated by the fact that the Christchurch High Court building was itself damaged in the earthquakes, with the Court having to relocate to temporary premises. (The High Court hears civil claims exceeding NZ$200,000 in value (approximately US$140,000) or those involving particularly complex issues. Most of the claims fell into this category.) This paper will examine the response of the Christchurch High Court to this extraordinary situation as a case study in innovative judging practices and from a jurisprudential perspective. In 2011, following the earthquakes, the High Court made a commitment that earthquake-related civil claims would be dealt with as swiftly as the Court's resources permitted. In May 2012, it commenced a special “Earthquake List” to manage these cases. The list (which is ongoing) seeks to streamline the trial process, resolve quickly claims with precedent value or involving acute personal hardship or large numbers of people, facilitate settlement and generally work proactively and innovatively with local lawyers, technical experts and other stakeholders. For example, the Court maintains a public list (in spreadsheet format, available online) with details of all active cases before the Court, listing the parties and their lawyers, summarising the facts and identifying the legal issues raised. It identifies cases in which issues of general importance have been or will be decided, with the expressed purpose being to assist earthquake litigants and those contemplating litigation and to facilitate communication among parties and lawyers. This paper will posit the Earthquake List as an attempt to implement innovative judging techniques to provide efficient yet just legal processes, and which can be examined from a variety of jurisprudential perspectives. One of these is as a case study in the well-established debate about the dialogic relationship between public decisions and private settlement in the rule of law. Drawing on the work of scholars such as Hazel Genn, Owen Fiss, David Luban, Carrie Menkel-Meadow and Judith Resnik, it will explore the tension between the need to develop the law through the doctrine of precedent and the need to resolve civil disputes fairly, affordably and expeditiously. It will also be informed by the presenter’s personal experience of the interplay between reported decisions and private settlement in post-earthquake Christchurch through her work mediating insurance disputes. From a methodological perspective, this research project itself gives rise to issues suitable for discussion at the Law and Society Annual Meeting. These include the challenges in empirical study of judges, working with data collected by the courts and statistical analysis of the legal process in reference to settlement. September 2015 marked the five-year anniversary of the first Christchurch earthquake. There remains widespread dissatisfaction amongst Christchurch residents with the ongoing delays in resolving claims, particularly insurers, and the rebuild process. There will continue to be challenges in Christchurch for years to come, both from as-yet unresolved claims but also because of the possibility of a new wave of claims arising from poor quality repairs. Thus, a final purpose of presenting this paper at the 2016 Meeting is to gain the benefit of other scholarly perspectives and experiences of innovative judging best practice, with a view to strengthening and improving the judicial processes in Christchurch. Soil Liquefaction during Recent Large-Scale Earthquakes contains selected papers presented at the New Zealand – Japan Workshop on Soil Liquefaction during Recent Large-Scale Earthquakes (Auckland, New Zealand, 2-3 December 2013). The 2010-2011 Canterbury earthquakes in New Zealand and the 2011 off the Pacific Coast of Tohoku Earthquake in Japan have caused significant damage to many residential houses due to varying degrees of soil liquefaction over a very wide extent of urban areas unseen in past destructive earthquakes. While soil liquefaction occurred in naturally-sedimented soil formations in Christchurch, most of the areas which liquefied in Tokyo Bay area were reclaimed soil and artificial fill deposits, thus providing researchers with a wide range of soil deposits to characterize soil and site response to large-scale earthquake shaking. Although these earthquakes in New Zealand and Japan caused extensive damage to life and property, they also serve as an opportunity to understand better the response of soil and building foundations to such large-scale earthquake shaking. With the wealth of information obtained in the aftermath of both earthquakes, information-sharing and knowledge-exchange are vital in arriving at liquefaction-proof urban areas in both countries. Data regarding the observed damage to residential houses as well as the lessons learnt are essential for the rebuilding efforts in the coming years and in mitigating buildings located in regions with high liquefaction potential. Observations made in past earthquakes, in New Zealand and around the world, have highlighted the vulnerability of non-structural elements such as facades, ceilings, partitions and services. Damage to these elements can be life-threatening or jeopardise egress routes but typically, the main concern is the cost and time associated with repair works. The Insurance Council of New Zealand highlighted the substantial economic losses in recent earthquakes due to poor performance of non-structural elements. Previous inspections and research have attributed the damage to non-structural elements principally to poor coordination, inadequate or lack of seismic restraints and insufficient clearances to cater for seismic actions. Secondary issues of design responsibility, procurement and the need for better alignment of the various Standards have been identified. In addition to the compliance issues, researchers have also demonstrated that current code provisions for non-structural elements, both in New Zealand and abroad, may be inadequate. This paper first reviews the damage observed against the requirements of relevant Standards and the New Zealand Building Code, and it appears that, had the installations been compliant, the cost of repair and business interruption would have been substantially less. The second part of the paper highlights some of the apparent shortcomings with the current design process for non-structural elements, points towards possible alternative strategies and identifies areas where more research is deemed necessary. The challenge of improving the seismic performance of non-structural elements is a complex one across a diverse construction industry. Indications are that the New Zealand construction industry needs to completely rethink the delivery approach to ensure an integrated design, construction and certification process. The industry, QuakeCentre, QuakeCoRE and the University of Canterbury are presently working together to progress solutions. Indications are that if new processes can be initiated, better performance during earthquakes will be achieved while delivering enhanced building and business resilience.
During the past two decades, the focus has been on the need to provide communities with structures that undergo minimal damage after an earthquake event while still being cost competitive. This has led to the development of high performance seismic resisting systems, and advances in design methodologies, in order respect this demand efficiently. This paper presents the experimental response of four pre-cast, post-tensioned rocking wall systems tested on the shake-table at the University of Canterbury. The wall systems were designed as a retrofit solution for an existing frame building, but are equally applicable for use in new design. Design of the wall followed a performance-based retrofit strategy in which structural limit states appropriate to both the post-tensioned wall and the existing building were considered. Dissipation for each of the four post-tensioned walls was provided via externally mounted devices, located in parallel to post-tensioned tendons for re-centring. This allowed the dissipation devices to be easily replaced or inspected following a major earthquake. Each wall was installed with viscous fluid dampers, tension-compression yielding steel dampers, a combination of both or no devices at all – thus relying on contact damping alone. The effectiveness of both velocity and displacement dependant dissipation are investigated for protection against far-field and velocity-pulse ground motion characteristics. The experimental results validate the behaviour of ‘Advanced Flag-Shape’ rocking, dissipating solutions which have been recently proposed and numerically tested. Maximum displacements and material strains were well controlled and within acceptable bounds, and residual deformations were minimal due to the re-centring contribution from the post-tensioned tendons. Damage was confined to inelastic yielding (or fluid damping) of the external dampers.
On 22 February 2011,a magnitude Mw 6.3 earthquake occurred with an epicenter located near Lyttelton at about 10km from Christchurch in Canterbury region on the South Island of New Zealand (Figure 1). Since this earthquake occurred in the midst of the aftershock activity which had continued since the 4 September 2010 Darfield Earthquake occurrence, it was considered to be an aftershock of the initial earthquake. Because of the short distance to the city and the shallower depth of the epicenter, this earthquake caused more significant damage to pipelines, traffic facilities, residential houses/properties and multi-story buildings in the central business district than the September 2010 Darfield Earthquake in spite of its smaller earthquake magnitude. Unfortunately, this earthquake resulted in significant number of casualties due to the collapse of multi-story buildings and unreinforced masonry structures in the city center of Christchurch. As of 4 April, 172 casualties were reported and the final death toll is expected to be 181. While it is extremely regrettable that Christchurch suffered a terrible number of victims, civil and geotechnical engineers have this hard-to-find opportunity to learn the response of real ground from two gigantic earthquakes which occurred in less than six months from each other. From geotechnical engineering point of view, it is interesting to discuss the widespread liquefaction in natural sediments, repeated liquefaction within short period and further damage to earth structures which have been damaged in the previous earthquake. Following the earthquake, an intensive geotechnical reconnaissance was conducted to capture evidence and perishable data from this event. This project looks at how destroyed architecture, although physically lost, fundamentally continues to exist within human memories as a non-physical entity. The site chosen is Avonside Girls’ High School in Christchurch, New Zealand, a school heavily damaged during the February 22nd earthquake in 2011. The project focuses on the Main Block, a 1930s masonry building which had always been a symbol for the school and its alumni. The key theories relevant to this are studies on non-material architecture and memory as these subjects investigate the relationship between conceptual idea and the triggering of it. This research aims to study how to fortify a thought-based architecture against neglect, similar to the retrofitting of physical structures. In doing so, the importance of the emotive realm of architecture and the idea behind a building (as opposed to the built component itself) is further validated, promoting more broadminded stances regarding the significance of the idea over the object. A new method for disaster recovery and addressing trauma from lost architecture is also acquired. Factors regarding advanced structural systems and programmes are not covered within the scope of this research because the project instead explores issues regarding the boundaries between the immaterial and material. The project methodology involves communicating a narrative derived from the memories alumni and staff members have of the old school block. The approach for portraying the narrative is based on a list of strategies obtained from case studies. The final product of the research is a new design for the high school, conveyed through a set of atmospheric drawings that cross-examines the boundaries between the physical and non-physical realms by representing the version of the school that exists solely within memories.
Urban Ensembles explores the way in which landscape and architecture can be employed together within the design of a steep, urban site. Lyttelton is a small port town on the border of Christchurch, settled in the foothills of a harbour formed by a major volcanic eruption. This rugged setting, with steeply sloping urban terrain, presents an interesting challenge when designing an urban development. The site was badly damaged in a series of earthquakes in 2010-2011, and many of the town’s oldest buildings, heritage structures dating back to the colonial settlement era, were destroyed. This has left a void in the heart of Lyttelton, and caused the loss of much of the tourism business that the town relies upon for its income. This thesis takes a methodological approach to the design of landscape architecture on such a challenging site. A range of techniques are explored, drawing from both landscape and architecture to explore the roles that each discipline plays in the design of urban spaces. The frequent imbalance between disciplines is addressed both through the literature review and design method, as this landscape architecture thesis draws on architectural design as a tool for generating spaces which fall somewhere in between the two ideals of interior and exterior. The final design proposal is an alternative rebuild plan for the central business area to the south of London St, and also addresses the relationships between that site and the surrounding context, both urban and environmental. The aim of this design is to create a series of interconnected spaces which have a strong relationship to the surrounding harbour setting, and also to facilitate development of the pedestrian spaces throughout the block and encouraging the development of activity at the street level, through the interface between buildings and landscape.

The major earthquakes of 2010 and 2011 brought to an abrupt end a process of adaptive reuse, revitalisation and gentrification that was underway in the early 20th century laneways and buildings located in the south eastern corner of the Christchurch Central Business District. Up until then, this location was seen as an exemplar of how mixed use could contribute to making the central city an attractive and viable alternative to the suburban living experience predominant in New Zealand. This thesis is the result of a comprehensive case study of this “Lichfield Lanes” area, which involved in depth interviews with business owners, observation of public meetings and examination of documents and the revitalisation research literature. Findings were that many of the factors seen to make this location successful pre-earthquakes mirror the results of similar research in other cities. These factors include: the importance of building upon historic architecture and the eclectic spaces this creates; a wide variety of uses generating street life; affordable rental levels; plus the dangers of uniformity of use brought about by focussing on business types that pay the most rent. Also critical is co-operation between businesses to create and effectively market and manage an identifiable precinct that has a coherent style and ambience that differentiates the location from competing suburban malls. In relation to the latter, a significant finding of this project was that the hospitality and retail businesses key to the success of Lichfield Lanes were not typical and could be described as quirky, bohemian, chaotic, relatively low rent, owner operated and appealing to the economically important “Creative Class” identified by Richard Florida (2002) and others. In turn, success for many of these businesses can be characterised as including psychological and social returns rather than simply conventional economic benefits. This has important implications for inner city revitalisation, as it contrasts with the traditional focus of local authorities and property developers on physical aspects and tenant profitability as measures of success. This leads on to an important conclusion from this research, which is that an almost completely inverted strategy from that applied to suburban mall development, may be most appropriate for successful inner city revitalisation. It also highlights a disconnection between the focus and processes of regulatory authorities and the outcomes and processes most acceptable to the people likely to frequent the central city. Developers are often caught in the middle of this conflicted situation. Another finding was early commitment by businesses to rebuild the case study area in the same style, but over time this waned as delay, demolition, insurance problems, political and planning uncertainty plus other issues made participation by the original owners and tenants impossible or uneconomic. In conclusion, the focus of inner city revitalisation is too often on buildings rather than the people that use them and what they now desire from the central city.

There has been little discussion of what archival accounting evidence can contribute to an understanding of a society’s response to a natural disaster. This article focuses on two severe earthquakes which struck New Zealand in 1929 and 1931 and makes two main contributions to accounting history. First, by discussing evidence from archival sources, it contributes to the literature on accounting in a disaster. This provides a basis for future theory building and for future comparative research related to the response to more recent natural disasters such as the 2010–11 Canterbury earthquakes. Secondly, it questions the conclusions of recently published research concerning the role of central and local government in this and recent earthquakes.
A large number of businesses that used to be in the centre of Christchurch relocated after the earthquakes. Are they satisfied with their new locations and do they intend to return to the central city? We questioned 209 relocated businesses about their relocation history, present circumstances and future intentions. Many businesses were content with their new premises, despite having encountered a range of problems; those businesses that were questioned later in our survey period were more content. The average business in our sample rated the chances of moving back to the central city as around 50 %, but this varies with the type of business. Building height did not emerge as a major issue, but rents may be. The mix of types of business is likely to be different in the new city centre.
One of the most controversial issues highlighted by the 2010-2011 Christchurch earthquake series and more recently the 2016 Kaikoura earthquake, has been the evident difficulty and lack of knowledge and guidelines for: a) evaluation of the residual capacity damaged buildings to sustain future aftershocks; b) selection and implementation of a series of reliable repairing techniques to bring back the structure to a condition substantially the same as prior to the earthquake; and c) predicting the cost (or cost-effectiveness) of such repair intervention, when compared to fully replacement costs while accounting for potential aftershocks in the near future. As a result of such complexity and uncertainty (i.e., risk), in combination with the possibility (unique in New Zealand when compared to most of the seismic-prone countries) to rely on financial support from the insurance companies, many modern buildings, in a number exceeding typical expectations from past experiences at an international level, have ended up being demolished. This has resulted in additional time and indirect losses prior to the full reconstruction, as well as in an increase in uncertainty on the actual relocation of the investment. This research project provides the main end-users and stakeholders (practitioner engineers, owners, local and government authorities, insurers, and regulatory agencies) with comprehensive evidence-based information to assess the residual capacity of damage reinforced concrete buildings, and to evaluate the feasibility of repairing techniques, in order to support their delicate decision-making process of repair vs. demolition or replacement. Literature review on effectiveness of epoxy injection repairs, as well as experimental tests on full-scale beam-column joints shows that repaired specimens have a reduced initial stiffness compared with the undamaged specimen, with no apparent strength reduction, sometimes exhibiting higher displacement ductility capacities. Although the bond between the steel and concrete is only partially restored, it still allows the repaired specimen to dissipate at least the same amount of hysteretic energy. Experimental tests on buildings subjected to earthquake loading demonstrate that even for severe damage levels, the ability of the epoxy injection to restore the initial stiffness of the structure is significant. Literature review on damage assessment and repair guidelines suggests that there is consensus within the international community that concrete elements with cracks less than 0.2 mm wide only require cosmetic repairs; epoxy injection repairs of cracks less and 2.0 mm wide and concrete patching of spalled cover concrete (i.e., minor to moderate damage) is an appropiate repair strategy; and for severe damaged components (e.g., cracks greater than 2.0 mm wide, crushing of the concrete core, buckling of the longitudinal reinforcement) local replacement of steel and/or concrete in addition to epoxy crack injection is more appropriate. In terms of expected cracking patterns, non-linear finite element investigations on well-designed reinforced concrete beam-to-column joints, have shown that lower number of cracks but with wider openings are expected to occur for larger compressive concrete strength, f’c, and lower reinforcement content, ρs. It was also observed that the tensile concrete strength, ft, strongly affects the expected cracking pattern in the beam-column joints, the latter being more uniformly distributed for lower ft values. Strain rate effects do not seem to play an important role on the cracking pattern. However, small variations in the cracking pattern were observed for low reinforcement content as it approaches to the minimum required as per NZS 3101:2006. Simple equations are proposed in this research project to relate the maximum and residual crack widths with the steel strain at peak displacement, with or without axial load. A literature review on fracture of reinforcing steel due to low-cycle fatigue, including recent research using steel manufactured per New Zealand standards is also presented. Experimental results describing the influence of the cyclic effect on the ultimate strain capacity of the steel are also discussed, and preliminary equations to account for that effect are proposed. A literature review on the current practice to assess the seismic residual capacity of structures is also presented. The various factors affecting the residual fatigue life at a component level (i.e., plastic hinge) of well-designed reinforced concrete frames are discussed, and equations to quantify each of them are proposed, as well as a methodology to incorporate them into a full displacement-based procedure for pre-earthquake and post-earthquake seismic assessment.

An often overlooked aspect of urban housing development is the composition of the space between buildings; the streetscape. The pressures of suppressing suburban sprawl have seen housing developments respond by increasing residential density within more centralised city sites. Medium-density housing typologies are often used as urban infill in response to the challenge of accommodating an increasing population. A by-product of these renewed areas is the creation of new open space which serves as the fundamental public space for sociability to develop in communities. Street space should emphasise this public expression by encouraging social exchange and interaction. As a result, a neighbourhood owes its liveliness (or lack thereof) to its streets. The issue of density when applied to the urban housing landscape encompasses two major components: the occupancy of both the private realms, constituting the residential built form, and the public spaces that adjoins them, the streets. STREETSCAPE: dialogues of street + house. Continual transition between the realms of public and private (building and street space) enact active edges, giving way to public stimulation; the opportunity for experiencing other people. The advent of seeing and hearing other people in connection with daily comings and goings encourages social events to evolve, enhancing the notion of neighbourly conduct. Within New Zealand, and specifically in Christchurch as considered here, the compositions of current streetscapes lack the demeanor to really encourage and facilitate the idea of neighbourly interaction and public expression. Here lies the potential for new street design to significantly heighten the interplay of human activity. In response, this research project operates under the notion that the street spaces of urban residential areas are largely underutilised. This lack is particularly evident in the street. Street design should strive to produce spaces which stimulate the public life of residents. There exists a need to reassert eminence of the street as a space for vibrant neighbourhood life. This thesis employs design as a tool for researching and will involve using numerous concept generators to trigger the production of multiple scenarios. These scenarios are to explore the ways in which the streetscapes within medium-density urban communities could respond in the event of (re) development.
