The 4th of September 2010 Mw 7.1 Darfield (Canterbury) earthquake had generated significant ground shaking within the Christchurch Central Business District (CBD). Despite the apparently significant shaking, the observed structural damage for pre-1970s reinforced concrete (RC) buildings was indeed limited and lower than what was expected for such typology of buildings. This paper explores analytically and qualitatively the different aspects of the "apparent‟ good seismic performance of the pre-1970s RC buildings in the Christchurch CBD, following the earthquake reconnaissance survey by the authors. Damage and building parameters survey result, based on a previously established inventory of building stock of these non-ductile RC buildings, is briefly reported. From an inventory of 75 buildings, one building was selected as a numerical case-study to correlate the observed damage with the non-linear analyses. The result shows that the pre-1970s RC frame buildings performed as expected given the intensity of the ground motion shaking during the Canterbury earthquake. Given the brittle nature of this type of structure, it was demonstrated that more significant structural damage and higher probability of collapse could occur when the buildings were subjected to alternative input signals with different frequency content and duration characteristics and still compatible to the seismicity hazard for Christchurch CBD.

The Porters Pass fault (PPF) is a prominent element of the Porters Pass-Amberley Fault Zone (PPAFZ) which forms a broad zone of active earth deformation ca 100 km long, 60-90 km west and north of Christchurch. For a distance of ca 40 km the PPF is defined by a series of discontinuous Holocene active traces between the Rakaia and Waimakariri Rivers. The amount of slip/event and the timing of paleoearthquakes are crucial components needed to estimate the earthquake potential of a fault. Movement was assumed to be, coseismic and was quantified by measuring displaced geomorphic features using either tape measure or surveying equipment. Clustering of offset data suggests that four to five earthquakes occurred on the PPF during the Holocene and these range between ca 5-7 m/event. Timing information was obtained from four trenches excavated across the fault and an auger adjacent to the fault. Organic samples from these sites were radiocarbon dated and used in conjunction with data from previous studies to identify the occurrence of at least four earthquakes at 8500 ± 200, 5300 ± 700, 2500 ± 200 and 1000 ± 100 years B.P. Evidence suggests that an additional event is also possible at 6200 ± 500 years B.P. The ~1000, 5300 and 6200 years B.P. paleoearthquakes were previously unrecognised, while the 500 year event previously inferred from rock-avalanche data has been discarded. The present data set produces recurrence intervals of ~2000-2500 years for the Holocene. The identification of only one Holocene PPF rupture to the west of Red Lakes indicates the presence of a segment boundary that prevents the propagation of rupture beyond this point. This is consistent with displacement data and results in slip rates of 0.5-0.7 mm/yr and 2.5-3.4 mm/yr to the west and east of Red Lakes respectively. It is possible that the nearby extensional Red Hill Fault influences PPF rupture propagation. The combination of geometric, slip rate and timing data has enabled the magnitude of prehistoric earthquakes on the PPF to be estimated. These magnitudes range from an average of between 6.9 for a fault rupture from Waimakariri River to Red Lakes, to a maximum of 7.4 that ruptures the entire length of the PPAFZ, including the full length of the PPF. These estimates are approximately consistent with previous magnitude estimates along the full length of the PPAFZ of between 7.0 and 7.5.
The Canterbury earthquakes in 2010 and 2011 had a significant impact on landlords and tenants of commercial buildings in the city of Christchurch. The devastation wrought on the city was so severe that in an unprecedented response to this disaster a cordon was erected around the central business district for nearly two and half years while demolition, repairs and rebuilding took place. Despite the destruction, not all buildings were damaged. Many could have been occupied and used immediately if they had not been within the cordoned area. Others had only minor damage but repairs to them could not be commenced, let alone completed, owing to restrictions on access caused by the cordon. Tenants were faced with a major problem in that they could not access their buildings and it was likely to be a long time before they would be allowed access again. The other problem was uncertainty about the legal position as neither the standard form leases in use, nor any statute, provided for issues arising from an inaccessible building. The parties were therefore uncertain about their legal rights and obligations in this situation. Landlords and tenants were unsure whether tenants were required to pay rent for a building that could not be accessed or whether they could terminate their leases on the basis that the building was inaccessible. This thesis looks at whether the common law doctrine of frustration could apply to leases in these circumstances, where the lease had made no provision. It analyses the history of the doctrine and how it applies to a lease, the standard form leases in use at the time of the earthquakes and the unexpected and extraordinary nature of the earthquakes. It then reports on the findings of the qualitative empirical research undertaken to look at the experiences of landlords and tenants after the earthquakes. It is argued that the circumstances of landlords and tenants met the test for the doctrine of frustration. Therefore, the doctrine could have applied to leases to enable the parties to terminate them. It concludes with a suggestion for reform in the form of a new Act to govern the special relationship between commercial landlords and tenants, similar to legislation already in place covering other types of relationships like those in residential tenancies and employment. Such legislation could provide dispute resolution services to enable landlords and tenants to have access to justice to determine their legal rights at all times, and in particular, in times of crisis.

The National Science Challenge ‘Building Better Homes, Towns and Cities’ is currently undertaking work that, in part, identifies and analyses the Waimakariri District Council’s (WMK/Council) organisational practices and process tools. The focus is on determining the processes that made the Residential Red Zone Recovery Plan, 2016 (RRZRP) collaboration process so effective and compares it to the processes used to inform the current Kaiapoi Town Centre Plan - 2028 and Beyond (KTC Plan). This research aims to explore ‘what travelled’ in terms of values, principles, methods, processes and personnel from the RRZRP to the KTC planning process. My research will add depth to this research by examining more closely the KTC Plan’s hearings process, reviewing submissions made, analysing background documents and by conducting five semi-structured interviews with a selection of people who made submissions on the KTC Plan. The link between community involvement and best recovery outcomes has been acknowledged in literature as well as by humanitarian agencies (Lawther, 2009; Sullivan, 2003). My research has documented WMK’s post-quake community engagement strategy by focusing on their initial response to the earthquake of 2010 and the two-formal plan (RRZRP and KTC Plan) making procedures that succeeded this response. My research has led me to conclude that WMK was committed to collaborating with their constituents right through the extended post-quake sequence. Iterative face to face or ‘think communications’ combined with the accessibility of all levels of Council staff – including senior management and elected members - gave interested community members the opportunity to discuss and deliberate the proposed plans with the people tasked with preparing them. WMK’s commitment to collaborate is illustrated by the methods they employed to inform their post-quake efforts and plans and by the logic behind the selected methods. Combined the Council’s logic and methods best describe the ‘Waimakariri Way’. My research suggests that collaborative planning is iterative in nature. It is therefore difficult to establish a specific starting point where collaboration begins as the relationships needed for the collaborative process constantly (re)emerge out of pre-existing relationships. Collaboration seems to be based on an attitude, which means there is no starting ‘point’ as such, rather an amplification for a time of a basic attitude towards the public.

This thesis focuses on the role of legal preparedness for managing large-scale urban disasters in Aotearoa New Zealand. It uses the Auckland Volcanic Field as a case study to answer the question: ‘is New Zealand’s current legal framework prepared to respond to and recover from a large-scale urban disaster?’. The Auckland Volcanic Field was chosen as the main case study because a future eruption is a low likelihood, high-impact event that New Zealand is going to have to manage in the future. Case studies are a key feature of this thesis as both New Zealand based and overseas examples are used to explore the role of legal preparedness by identifying and investigating a range of legal issues that need to be addressed in advance of a future Auckland Volcanic Field eruption. Of particular interest is the impact of legal preparedness for the recovery phase. The New Zealand case studies include; Canterbury earthquake sequence 2010-2011, the Kaikōura earthquake 2016, the Auckland flooding 2018, and the North Island Severe Weather event 2023, which encompasses both the Auckland Anniversary weekend flooding and Cyclone Gabrielle. As New Zealand has not experienced a large-scale urban volcanic eruption, overseas examples are explored to provide insights into the legal issues that are volcano specific. The overseas volcanic case studies cover eruptions in Heimaey (Iceland), the Soufrière Hills (Montserrat and the Grenadines), La Soufrière (St Vincent) and Tungurahua (Ecuador). New Zealand’s past experiences highlight a trend for introducing post-event legal frameworks to manage recovery. Consequently, the current disaster management system is not prioritising legal preparedness and instead is choosing to rely on exceptional powers. Unsurprisingly, the introduction of new post-event recovery frameworks has repercussions. In New Zealand, new post-event legal frameworks are introduced swiftly under urgency, they contain broad unstructured decision-making powers, and are often flawed. As these exceptional new frameworks sit outside the ‘normal’ legal frameworks, they in effect create a parallel “shadow system”. Based on the evidence explored in this thesis it does not appear that Auckland’s current disaster management framework is prepared to deal with a large-scale urban event caused by an Auckland Volcanic Field eruption. Following this conclusion, it is the submission of this thesis that New Zealand’s current legal framework is not prepared to respond to and recover from a large-scale urban disaster. To become legally prepared, New Zealand needs to consider the legal tools required to manage large-scale urban disasters in advance. This will prevent the creation of a legal vacuum in the aftermath of disasters and the need for new recovery frameworks. Adopting a new attitude will require a change in approach towards legal preparedness which prioritises it, rather than sidelining it. This may also require changes within New Zealand’s disaster management system including the introduction of a formal monitoring mechanism, which will support and prioritise legal preparedness. This thesis has shown that not legally preparing for future disasters is a choice which carries significant consequences. None of these consequences are inevitable when managing large-scale disasters, however they are inevitable when frameworks are not legally prepared in advance. To not legally prepare, is to prepare to fail and thus create a disaster by choice.
Globally, the maximum elevations at which treelines are observed to occur coincide with a 6.4 °C soil isotherm. However, when observed at finer scales, treelines display a considerable degree of spatial complexity in their patterns across the landscape and are often found occurring at lower elevations than expected relative to the global-scale pattern. There is still a lack of understanding of how the abiotic environment imposes constraints on treeline patterns, the scales at which different effects are acting, and how these effects vary over large spatial extents. In this thesis, I examined abrupt Nothofagus treelines across seven degrees of latitude in New Zealand in order to investigate two broad questions: (1) What is the nature and extent of spatial variability in Nothofagus treelines across the country? (2) How is this variation associated with abiotic variation at different spatial scales? A range of GIS, statistical, and atmospheric modelling methods were applied to address these two questions. First, I characterised Nothofagus treeline patterns at a 15x15km scale across New Zealand using a set of seven, GIS-derived, quantitative metrics that describe different aspects of treeline position, shape, spatial configuration, and relationships with adjacent vegetation. Multivariate clustering of these metrics revealed distinct treeline types that showed strong spatial aggregation across the country. This suggests a strong spatial structuring of the abiotic environment which, in turn, drives treeline patterns. About half of the multivariate treeline metric variation was explained by patterns of climate, substrate, topographic and disturbance variability; on the whole, climatic and disturbance factors were most influential. Second, I developed a conceptual model that describes how treeline elevation may vary at different scales according to three categories of effects: thermal modifying effects, physiological stressors, and disturbance effects. I tested the relevance of this model for Nothofagus treelines by investigating treeline elevation variation at five nested scales (regional to local) using a hierarchical design based on nested river catchments. Hierarchical linear modelling revealed that the majority of the variation in treeline elevation resided at the broadest, regional scale, which was best explained by the thermal modifying effects of solar radiation, mountain mass, and differences in the potential for cold air ponding. Nonetheless, at finer scales, physiological and disturbance effects were important and acted to modify the regional trend at these scales. These results suggest that variation in abrupt treeline elevations are due to both broad-scale temperature-based growth limitation processes and finer-scale stress- and disturbance-related effects on seedling establishment. Third, I explored the applicability of a meso-scale atmospheric model, The Air Pollution Model (TAPM), for generating 200 m resolution, hourly topoclimatic data for temperature, incoming and outgoing radiation, relative humidity, and wind speeds. Initial assessments of TAPM outputs against data from two climate station locations over seven years showed that the model could generate predictions with a consistent level of accuracy for both sites, and which agreed with other evaluations in the literature. TAPM was then used to generate data at 28, 7x7 km Nothofagus treeline zones across New Zealand for January (summer) and July (winter) 2002. Using mixed-effects linear models, I determined that both site-level factors (mean growing season temperature, mountain mass, precipitation, earthquake intensity) and local-level landform (slope and convexity) and topoclimatic factors (solar radiation, photoinhibition index, frost index, desiccation index) were influential in explaining variation in treeline elevation within and among these sites. Treelines were generally closer to their site-level maxima in regions with higher mean growing season temperatures, larger mountains, and lower levels of precipitation. Within sites, higher treelines were associated with higher solar radiation, and lower photoinhibition and desiccation index values, in January, and lower desiccation index values in July. Higher treelines were also significantly associated with steeper, more convex landforms. Overall, this thesis shows that investigating treelines across extensive areas at multiple study scales enables the development of a more comprehensive understanding of treeline variability and underlying environmental constraints. These results can be used to formulate new hypotheses regarding the mechanisms driving treeline formation and to guide the optimal choice of field sites at which to test these hypotheses.
The former Earthquake Commission minister, Gerry Brownlee, is defending EQC over claims its assessors in Christchurch were not properly qualified. A growing number of homeowners in the city are discovering EQC assessors have completely missed quake damage including broken foundations costing hundreds of thousands to repair. That's been disastrous for people who've bought homes with hidden damage who are sometimes finding private insurers unwilling to cover the cost of putting right mistakes made by EQC. The company hired by EQC to carry out repairs was Fletcher Construction. Its chief executive at the time, Mark Binns, told Checkpoint that EQC probably hired unqualified people to assess quake damaged homes. Gerry Brownlee refused to be drawn on the comments from Mr Binns. But when asked by RNZ Christchurch reporter, Conan Young, if it was acceptable to have retired policemen, school principals and vacuum cleaner salesmen carrying out assessments for EQC, he admitted finding enough people to do the job was a challenge.

As Auckland and Northland brace for more atrocious weather, city leaders are calling for funding to repair the city's broken infrastructure to be along the lines of the help given to Christchurch after the quakes. Auckland deputy mayor Desley Simpson says that the damage so far is equivalent to the biggest non earthquake event the country has ever had and should be treated accordingly. The Opportunities Party says the "alliance" model established after the earthquakes, was effective and would work for Auckland's rebuild, because it provides a structure that the Central Government can fund directly. ToP leader Raf Manji was a Christchurch councillor after the quakes and closely involved in the rebuild. He tells Kathryn Ryan it is vital to ensure water and transport infrastructure is repaired quickly and efficiently, especially with a view to future extreme weather events - and there is much to learn from the post-quake rebuild.
