The Canterbury earthquakes of 2010 and 2011 have shone the spotlight on a number of tax issues. These issues, and in particular lessons learned from them, will be relevant for revenue authorities, policymakers and taxpayers alike in the broader context of natural disasters. Issues considered by this paper include the tax treatment of insurance monies. For example, building owners will receive pay-outs for destroyed assets and buildings which have been depreciated. Where the insurance payment is more than the adjusted tax value, there will be a taxable "gain on sale" (or depreciation recovery income). If the building owner uses those insurance proceeds to purchase a replacement asset, legislative amendments specifically enacted following the earthquakes provide that rollover relief of the depreciation recovery income is available. The tax treatment of expenditure to seismically strengthen a building is another significant issue faced by building owners. Case law has determined that this expenditure will usually be capital expenditure. In the past such costs could be capitalised to the building and depreciated accordingly. However, since the 2011-2012 income year owners have been prohibited from claiming depreciation on buildings and therefore currently no deduction is available for such strengthening expenditure (whether immediate or deferred). This has significant potential implications for landlords throughout New Zealand facing significant seismic retrofit costs. Incentives, or some form of financial support, whether delivered through the tax system or some other mechanism may be required. International Financial Reporting Standards (IFRS) require insurance proceeds, including reimbursement for expenditure of a capital nature, be reported as income while expenditure itself is not recorded as a current period expense. This has the effect of overstating current income and creating a larger variation between reported income for accounting and taxation purposes. Businesses have obligations to maintain certain business records for tax purposes. Reconstructing records destroyed by a natural disaster depends on how the information was originally stored. The earthquakes have demonstrated the benefits of ‘off-site’ (outside Canterbury) storage, in particular electronic storage. This paper considers these issues and the Inland Revenue Department (Inland Revenue) Standard Practice Statement which deals with inter alia retention of business records in electronic format and offshore record storage. Employer provided accommodation is treated as income to the benefitting employee. A recent amendment to the Income Tax Act 2007 retrospectively provides that certain employer provided accommodation is exempt from tax. The time aspect of these rules is extended where the employee is involved in the Canterbury rebuild and comes from outside the region.

The David and Goliath battle over a heritage building sitting in the way of a planned $473 million dollar, multi-use arena for Christchurch has ended up in court. The 25,000-seated, roofed arena is the final anchor project for the Christchurch rebuild and will be designed to host everything from All Blacks tests to big concerts. But sitting on the edge of the site, at 212 Madras Street, is the NG Building, a 115-year old warehouse that's home to a number of creative businesses. It escaped the worst of the 2011 earthquake and was strengthened by its owners: Roland Logan and Sharon Ng. They say they were told in 2013 the building could be incorporated into the arena's design, and are at loggerheads over its compulsory acquisition. Last week they were at the High Court seeking an injunction that would allow them to temporarily maintain ownership of the building, and that decision was released yesterday - and upheld. Roland joins Kathryn to discuss why they hope the building can be saved.

Over 900 buildings in the Christchurch central business district and 10,000 residential homes were demolished following the 22nd of February 2011 Canterbury earthquake, significantly disrupting the rebuild progress. This study looks to quantify the time required for demolitions during this event which will be useful for future earthquake recovery planning. This was done using the Canterbury Earthquake Recovery Authority (CERA) demolition database, which allowed an in-depth look into the duration of each phase of the demolition process. The effect of building location, building height, and the stakeholder which initiated the demolition process (i.e. building owner or CERA) was investigated. The demolition process comprises of five phases; (i) decision making, (ii) procurement and planning, (iii) demolition, (iv) site clean-up, and (v) completion certification. It was found that the time required to decide to demolish the building made up majority of the total demolition duration. Demolition projects initiated by CERA had longer procurement and planning durations, but was quicker in other phases. Demolished buildings in the suburbs had a longer decision making duration, but had little effect on other phases of the demolition process. The decision making and procurement and planning phases of the demolition process were shorter for taller buildings, though the other phases took longer. Fragility functions for the duration of each phase in the demolition process are provided for the various categories of buildings for use in future studies.

Many buildings with relatively low damage from the 2010-2011 Canterbury were deemed uneconomic to repair and were replaced [1,2]. Factors that affected commercial building owners’ decisions to replace rather than repair, included capital availability, uncertainty with regards to regional recovery, local market conditions and ability to generate cash flow, and repair delays due to limited property access (cordon). This poster provides a framework for modeling decision-making in a case where repair is feasible but replacement might offer greater economic value – a situation not currently modeled in engineering risk analysis.

This study is a qualitative investigation into the decision-making behaviour of commercial property owners (investors and developers) who are rebuilding in a city centre after a major disaster. In 2010/2011, Christchurch, the largest city in the South Island of New Zealand, was a site of numerous earthquakes. The stronger earthquakes destroyed many buildings and public infrastructure in the commercial inner city. As a result, affected property owners lost all or most of their buildings, a significant proportion of which were old and in the last phase of their life span. They had to negotiate pay-outs with insurance companies and decide, once paid out, whether they should rebuild in Christchurch or sell up and invest elsewhere. The clear majority of those who decided to reinvest in and rebuild the city are ‘locals’, almost all of whom had no prior experience of property development. Thus, in a post-disaster environment, most of these property owners have transitioned from being just being passive investors to active property developers. Their experience was interpreted using primary data gathered from in-depth and semi-structured interviews with twenty-one “informed property people” who included commercial property owners; property agents or consultants; representatives of public-sector agencies and financial institutions. The study findings showed that the decision-making behaviour of property investors and developers rebuilding after a major disaster did not necessarily follow a strict financial or profit motive as prescribed in the mainstream or neo-classical economics property literature. Rather, their decision-making behaviour has been largely shaped by emotional connections and external factors associated with their immediate environment. The theoretical proposition emerging from this study is that after a major disaster, local urban property owners are faced with two choices “to stay” or “to go”. Those who decide to stay and rebuild are typically very committed individuals who have a feeling of ownership, belonging and attachment to the city in which they live and work. These are people who will often take the lead in commercial property development, proactively making decisions and seeking positive investment outcomes for themselves which in turn result in revitalised commercial urban precincts.

Following the devastating 1931 Hawke's Bay earthquake, buildings in Napier and surrounding areas in the Hawke's Bay region were rebuilt in a comparatively homogenous structural and architectural style comprising the region's famous Art Deco stock. These interwar buildings are most often composed of reinforced concrete two-way space frames, and although they have comparatively ductile detailing for their date of construction, are often expected to be brittle, earthquake-prone buildings in preliminary seismic assessments. Furthermore, the likelihood of global collapse of an RC building during a design-level earthquake became an issue warranting particular attention following the collapse of multiple RC buildings in the February 22, 2011 Christchurch earthquake. Those who value the architectural heritage and future use of these iconic Art Deco buildings - including building owners, tenants, and city officials, among others - must consider how they can be best preserved and utilized functionally given the especially pressing implications of relevant safety, regulatory, and economic factors. This study was intended to provide information on the seismic hazard, geometric weaknesses, collapse hazards, material properties, structural detailing, empirically based vulnerability, and recommended analysis approaches particular to Art Deco buildings in Hawke's Bay as a resource for professional structural engineers tasked with seismic assessments and retrofit designs for these buildings. The observed satisfactory performance of similar low-rise, ostensibly brittle RC buildings in other earthquakes and the examination of the structural redundancy and expected column drift capacities in these buildings, led to the conclusion that the seismic capacity of these buildings is generally underrated in simple, force-based assessments.

Following the devastation of the Canterbury earthquake sequence a unique opportunity exists to rebuild and restructure the city of Christchurch, ensuring that its infrastructure is constructed better than before and is innovative. By installing an integrated grid of modern sensor technologies into concrete structures during the rebuild of the Christchurch CBD, the aim is to develop a network of self-monitored ‘digital buildings’. A diverse range of data will be recorded, potentially including parameters such as concrete stresses, strains, thermal deformations, acoustics and the monitoring of corrosion of reinforcement bars. This procedure will allow an on-going complete assessment of the structure’s performance and service life, both before and after seismic activity. The data generated from the embedded and surface mounted sensors will be analysed to allow an innovative and real-time health monitoring solution where structural integrity is continuously known. This indication of building performance will allow the structure to alert owners, engineers and asset managers of developing problems prior to failure thresholds being reached. A range of potential sensor technologies for monitoring the performance of existing and newly constructed concrete buildings is discussed. A description of monitoring work conducted on existing buildings during the July 2013 Cook Strait earthquake sequence is included, along with details of current work that investigates the performance of sensing technologies for detecting crack formation in concrete specimens. The potential market for managing the real-time health of installed infrastructure is huge. Civil structures all over the world require regular visual inspections in order to determine their structural integrity. The information recorded during the Christchurch rebuild will generate crucial data sets that will be beneficial in understanding the behaviour of concrete over the complete life cycle of the structure, from construction through to operation and building repairs until the time of failure. The greenhouses on the steep slopes of the Port Hills, as well as a big old villa and other brick buildings were badly damaged. Ten years on co-owner John Baxter says the earthquake damage is still being repaired, but sales have been boosted by a lack of imported flowers due to Covid-19 restrictions.

Though rare and unpredictable, earthquakes can and do cause catastrophic destruction when they impact unprepared and vulnerable communities. Extensive damage and failure of vulnerable buildings is a key factor which contributes to seismic-related disasters, making the proactive management of these buildings a necessity to reduce the risk of future disasters arising. The devastating Canterbury earthquakes of 2010 and 2011 brought the urgency of this issue to national importance in New Zealand. The national earthquake-prone building framework came into effect in 2017, obligating authorities to identify existing buildings with the greatest risk of collapse in strong earthquakes and for building owners to strengthen or demolish these buildings within a designated period of time. Though this framework is unique to New Zealand, the challenge of managing the seismic risk of such buildings is common amongst all seismically-active countries. Therefore, looking outward to examine how other jurisdictions legally manage this challenge is useful for reflecting on the approaches taken in New Zealand and understand potential lessons which could be adopted. This research compares the legal framework used to reduce the seismic risk of existing buildings in New Zealand with that of the similarly earthquake-prone countries of Japan and Italy. These legal frameworks are examined with a particular focus on the proactive goal of reducing risk and improving resilience, as is the goal of the international Sendai Framework for Disaster Risk Reduction 2015-2030. The Sendai Framework, which each of the case study countries have committed to and thus have obligations under, forms the legal basis of the need for states to reduce disaster risk in their jurisdictions. In particular, the states’ legal frameworks for existing building risk reduction are examined in the context of the Sendai priorities of understanding disaster risk, strengthening disaster risk governance, and investing in resilience. While this research illustrates that the case study countries have each adopted more proactive risk reduction frameworks in recent years in anticipation of future earthquakes, the frameworks currently focus on a very narrow range of existing buildings and thus are not currently sufficient for promoting the long-term resilience of building stocks. In order to improve resilience, it is argued, legal frameworks need to include a broader range of buildings subject to seismic risk reduction obligations and also to broaden the focus on long-term monitoring of potential risk to buildings.

This poster presents preliminary results of ongoing experimental campaigns at the Universities of Auckland and Canterbury, aiming at investigating the seismic residual capacity of damaged reinforced concrete plastic hinges, as well as the effectiveness of epoxy injection techniques for restoring their stiffness, energy dissipation, and deformation capacity characteristics. This work is part of wider research project which started in 2012 at the University of Canterbury entitled “Residual Capacity and Repairing Options for Reinforced Concrete Buildings”, funded by the Natural Hazards Research Platform (NHRP). This research project aims at gaining a better understanding and providing the main end-users and stakeholders (practitioner engineers, owners, local and government authorities, insurers, and regulatory agencies) with comprehensive evidence-based information and practical guidelines to assess the residual capacity of damaged reinforced concrete buildings, as well as to evaluate the feasibility of repairing and thus support their delicate decision-making process of repair vs. demolition or replacement.

The 2010 and 2011 earthquakes have had a devastating impact on the city of Christchurch, New Zealand. The level of destruction has been especially evident in the central business district where it has been estimated over 1000 buildings have already been or will eventually require demolition. Although, contrary to expectations, most of the fatalities were in relatively modern buildings, the Victorian and Edwardian era building stock was especially hard hit in terms of property damage. Unfortunately this era and style of building were also the focus of the most successful inner city revitalisation projects to date. A major research project is now underway examining the impact on the earthquakes on one of these revitalisation areas. The first step is to examine the international literature on similar inner city revitalisation or gentrification areas and in particular the characteristics of owners and occupiers attracted to this type of environment. This is the focus of this paper.

A Christchurch man with terminal cancer is using his final days to battle his insurance company, a decade on from the deadly earthquakes. Brian Shaw owns an apartment that's in a block of 11. They were all damaged in 2011. Shaw is a building consent officer. He says getting technical reports and chasing a settlement with insurer Vero has already cost the unit owners about $400,000, and they still have not even made it to court. On Friday morning he will be protesting outside Vero's Christchurch office, along with other unhappy customers.

The NMIT Arts & Media Building is the first in a new generation of multistorey timber structures. It employs an advanced damage avoidance earthquake design that is a world first for a timber building. Aurecon structural engineers are the first to use this revolutionary Pres-Lam technology developed at the University of Canterbury. This technology marks a fundamental change in design philosophy. Conventional seismic design of multi-storey structures typically depends on member ductility and the acceptance of a certain amount of damage to beams, columns and walls. The NMIT seismic system relies on pairs of coupled LVL shear walls that incorporate high strength steel tendons post-tensioned through a central duct. The walls are centrally fixed allowing them to rock during a seismic event. A series of U-shaped steel plates placed between the walls form a coupling mechanism, and act as dissipators to absorb seismic energy. The design allows the primary structure to remain essentially undamaged while readily replaceable connections act as plastic fuses. In this era where sustainability is becoming a key focus, the extensive use of timber and engineered-wood products such as LVL make use of a natural resource all grown and manufactured within a 100km radius of Nelson. This project demonstrates that there are now cost effective, sustainable and innovative solutions for multi-story timber buildings with potential applications for building owners in seismic areas around the world.

In the aftermath of the 2010-2011 Canterbury earthquakes in New Zealand, the residual capacity and reparability of damaged reinforced concrete (RC) structures was an issue pertinent to building owners, insurers, and structural engineers. Three precast RC moment-resisting frame specimens were extracted during the demolition of the Clarendon Tower in Christchurch after sustaining earthquake damage. These specimens were subjected to quasi-static cyclic testing as part of a research program to determine the reparability of the building. It was concluded that the precast RC frames were able to be repaired and retrofitted to an enhanced strength capacity with no observed reduction in displacement capacity, although the frames with “shear-ductile” detailing exhibited less displacement ductility capacity and energy dissipation capacity than the more conventionally detailed RC frames. The photographer comments, "This house at 158 Marine Parade, New Brighton, Christchurch was owned by the man leaning on the fence. He lived next door and his daughter lived here. During the earthquake the 2nd storey stayed mainly whole, but the 1st collapsed. Luckily the daughter was in the top storey. She was rescued from the building by neighbours, by climbing out of the window and down a ladder. Another piece of luck is that most of the belongings were stored in boxes in the garage at the front. Though the garage also collapsed the boxes appear intact. The owner had tried to sell it previously without success".

The Christchurch earthquakes brought to an abrupt halt a process of adaptive reuse and gentrification that was underway in the south eastern corner of the central business district. The retail uses that were a key to the success of this area pre-earthquake could be characterised as small, owner operated, quirky, bohemian, chaotic and relatively low rent. This research reports on the progress of a long term, comprehensive case study that follows the progress of these retailers both before and after the earthquakes. Findings include the immediate post-earthquake intentions to resume business in the same location as soon as possible were thwarted by government imposed cordons of the CBD that were only lifted nearly three years later. But, businesses were resilient and generally reinvented themselves quickly in alternative suburban locations where government “rebuild” restrictions were absent. It remains to be seen if this type of retail will ever return to the CBD as government imposed plans and the rents demanded for retail space in new buildings appear to preclude small owner-operated businesses.

The quality of multi-owned residential buildings and the capability to maintain that quality into the future is important in preserving not only the monetary value of such housing (Lujanen, 2010) but also the quality of life for its residents. The aim of this paper is to examine the governance and decision-making rules and regulations as they relate to the undertaking of major repairs in multi-owned residential buildings in Finland and New Zealand with particular regard to the Finnish Limited Liability Housing Companies Act 2010 (LLHCA 2010) and the New Zealand Unit Titles Act 2010 (UTA 2010). Currently, major building repairs are topical issues in both countries; in Finland as a result of ageing buildings requiring major re-fitting of pipes and other infrastructure, and in New Zealand as a result of earthquake damage in Christchurch and Leaky Building Syndrome nationwide. Major repairs can be a significant financial burden to unit owners and collective decisions can be difficult to achieve. Interestingly, new legislation that governs multi-owned housing was enacted in both countries in 2010. The recent enactment of this legislation provides an opportunity to examine the UTA 2010 and LLHCA 2010 with regard to how they address major repairs, improvements in housing stock and the financing possibilities associated with these undertakings. More specifically this paper explores housing intensification (i.e. building up, out or alongside existing multi-owned residential buildings on commonly owned land) as a means of financing major repairs. The comparison of governance and decision-making in two different shared ownership systems with different histories and cultural contexts provides a chance to explore the possibilities and challenges that each country faces, and the potential to learn from each other’s practices and develop these further. In this regard the findings from this paper contribute to the academic literature (Bugden 2005; Easthope & Randolph 2009; Dupuis & Dixon 2010; Lujanen 2010; Easthope, Hudson & Randolph 2013) concerning to the governance of multi-owned housing as it relates to intensive housing development and its wider social and economic implications.

Maybe there is a cosmic crack in everything, because in the Journal Astrophysical Letters it is noted that there is a huge deficit of light in the universe. Owners of heritage apartments in Auckland face becoming "impoverished" according to a high-profile real estate figure, because of new laws around earthquake strengthening. Martin Dunn of City Sales says the Building Amendment Bill is "overkill". He says those trying to sell heritage apartments are having a difficult time because of the new rules. Jim Anderton, has again raised the issue of whether the Christchurch Cathedral has to come down.
