This paper begins with a discussion of the history of negligent manslaughter in New Zealand and its development from the standard of ordinary negligence to the current test of a “major departure” from the expected standard of care, as set out under s 150A of the Crimes Act 1961. The paper then examines failings in s 150A’s current application, arguing that the “major departure” test has created injustices due to its strictly objective nature. Two examples of this are discussed in-depth, Bawa-Garba v R (UK) where a doctor was convicted of grossly negligent manslaughter for the death of her patient; and the decision not to prosecute the negligent engineers of the CTV building which collapsed in the Christchurch earthquake of 2011. The paper discusses three potential resolutions moving forward. It concludes that a more subjective interpretation of the wording of s 150A, which takes account of circumstances excusing or condemning a defendant’s conduct, would prevent future injustices and be a reasonably open interpretation on the wording of s 150A.
Six stands located on different land forms in mixed old-growth Nothofagus forests in the Matiri Valley (northwest of South Island, New Zealand) were sampled to examine the effects of two recent large earthquakes on tree establishment and tree-ring growth, and how these varied across land forms. 50 trees were cored in each stand to determine age structure and the cores were cross-dated to precisely date unusual periods of radial growth. The 1968 earthquake (M = 7.1, epicentre 35 km from the study area) had no discernible impact on the sampled stands. The impact of the 1929 earthquake (M = 7.7, epicentre 20 km from the study area) varied between stands, depending on whether or not they had been damaged by soil or rock movement. In all stands, the age structures showed a pulse of N. fusca establishment following the 1929 earthquake, with this species dominating establishment in large gaps created by landslides. Smaller gaps, created by branch or tree death, were closed by both N. fusca and N. menziesii. The long period of releases (1929-1945) indicates that direct earthquake damage was not the only cause of tree death, and that many trees died subsequently most likely of pathogen attack or a drought in the early 1930s. The impacts of the 1929 earthquake are compared to a storm in 1905 and a drought in 1974-1978 which also affected forests in the region. Our results confirm that earthquakes are an important factor driving forest dynamics in this tectonically active region, and that the diversity of earthquake impacts is a major source of heterogeneity in forest structure and regeneration.
Question: Does canopy tree regeneration response to different large disturbances vary with soil drainage? Location: Old-growth conifer (Dacrydium and Dacrycarpus), angiosperm (Nothofagus and Weinmannia) rain forest, Mount Harata, South Island, New Zealand. Methods: Trees were aged (1056 cores) to reconstruct stand history in 20 (0.12 - 0.2 ha) plots with different underlying drainage. Spatial analyses of an additional 805 tree ages collected from two (0.3 - 0.7 ha) plots were conducted to detect patchiness for five canopy tree species. Microsite preferences for trees and saplings were determined. Results: There were clear differences in species regeneration patterns on soils with different drainage. Conifer recruitment occurred infrequently in even-aged patches (> 1000 m²) and only on poorly drained soils. Periodic Nothofagus fusca and N. menziesii recruitment occurred more frequently in different sized canopy openings on all soils. Weinmannia recruitment was more continuous on all soils reflecting their greater relative shade-tolerance. Distinct periods of recruitment that occurred in the last 400 years matched known large disturbances in the region. These events affected species differently as soil drainage varied. Following earthquakes, both conifers and N. menziesii regenerated on poorly drained soils, while Nothofagus species and Weinmannia regenerated on well-drained soils. However, Dacrydium failed to regenerate after patchy storm damage in the wetter forest interior; instead faster-growing N. fusca captured elevated microsites caused by uprooting. Conclusions: Underlying drainage influenced species composition, while variation in the impacts of large disturbance regulated relative species abundances on different soils.
The timing of large Holocene prehistoric earthquakes is determined by dated surface ruptures and landslides at the edge of the Australia-Pacific plate boundary zone in North Canterbury, New Zealand. Collectively, these data indicate two large (M > 7) earthquakes during the last circa 2500 years, within a newly formed zone of hybrid strike-slip and thrust faulting herein described as the Porter's Pass-to-Amberley Fault Zone (PPAFZ). Two earlier events during the Holocene are also recognized, but the data prior to 2500 years are presumed to be incomplete. A return period of 1300–2000 years between large earthquakes in the PPAFZ is consistent with a late Holocene slip rate of 3–4 mm/yr if each displacement is in the range 4–8 m. Historical seismicity in the PPAFZ is characterized by frequent small and moderate magnitude earthquakes and a seismicity rate that is identical to a region surrounding the structurally mature Hope fault of the Marlborough Fault System farther north. This is despite an order-of-magnitude difference in slip rate between the respective fault zones and considerable differences in the recurrence rate of large earthquakes. The magnitude-frequency distribution in the Hope fault region is in accord with the characteristic earthquake model, whereas the rate of large earthquakes in the PPAFZ is approximated (but over predicted) by the Gutenberg-Richter model. The comparison of these two fault zones demonstrates the importance of the structural maturity of the fault zone in relation to seismicity rates inferred from recent, historical, and paleoseismic data.
This report reviews the literature on regeneration requirements of main canopy tree species in Westland. Forests managed for production purposes have to be harvested in an ecologically sustainable way; to maintain their natural character, harvesting should facilitate regeneration of target species and ensure that their recruitment is in proportion to the extent of extraction. The reasons for species establishing at any point in time are unclear; however, they are probably related to the availability of suitable microsites for establishment, the size of the canopy openings formed by disturbance, and whether or not seeds are available at or around the time of the disturbance. Age structures from throughout Westland show that extensive, similar-aged, post-earthquake cohorts of trees are a feature of the region. This suggests that infrequent, massive earthquakes are the dominant coarse-scale disturbance agent, triggering episodes of major erosion and sedimentation and leaving a strong imprint in the forest structure. In other forests, flooding and catastrophic windthrow are major forms of disturbance. The findings suggest that, in general, large disturbances are required for conifer regeneration. This has implications for any sustained yield management of these forests if conifers are to remain an important component. Any harvesting should recognise the importance for tree establishment of: forest floor microsites, such as fallen logs and tree tip-up mounds; and the variable way in which canopy gaps are formed. Harvesting should maintain the 'patchy' nature of the natural forest—large patches of dense conifers interspersed with more heterogeneous patches of mixed species.This is a client report commissioned by West Coast Conservancy and funded from the Unprogrammed Science Advice fund.
Artificial Neural Networks (ANN) as a tool offers opportunities for modeling the inherent complexity and uncertainty associated with socio-environmental systems. This study draws on New Zealand ski fields (multiple locations) as socio- environmental systems while considering their perceived resilience to low probability but potential high consequences catastrophic natural events (specifically earthquakes). We gathered data at several ski fields using a mixed methodology including: geomorphic assessment, qualitative interviews, and an adaptation of Ozesmi and Ozesmi’s (2003) multi-step fuzzy cognitive mapping (FCM) approach. The data gathered from FCM are qualitatively condensed, and aggregated to three different participant social groups. The social groups include ski fields users, ski industry workers, and ski field managers. Both quantitative and qualitative indices are used to analyze social cognitive maps to identify critical nodes for ANN simulations. The simulations experiment with auto-associative neural networks for developing adaptive preparation, response and recovery strategies. Moreover, simulations attempt to identify key priorities for preparation, response, and recovery for improving resilience to earthquakes in these complex and dynamic environments. The novel mixed methodology is presented as a means of linking physical and social sciences in high complexity, high uncertainty socio-environmental systems. Simulation results indicate that participants perceived that increases in Social Preparation Action, Social Preparation Resources, Social Response Action and Social Response Resources have a positive benefit in improving the resilience to earthquakes of ski fields’ stakeholders.

The objective of this is to understand better how the tourism sector sees its future and what challenges and opportunities lie ahead in both the short and longer term. State of Sector 2011, alongside the ongoing series of TIA Insights and other consultations that TIA is undertaking in its research work programme, is aimed at informing participants at the Tourism Summit taking place in Wellington on 13 July 2011. This information is a key driver in assisting with the development of the 2011 Tourism Industry Election Manifesto. State of the Sector 2011 also ultimately provides a current view of the tourism sector for those within the industry and for external stakeholders who have an interest in tourism in New Zealand.
The 48hr Design Challenge, run by the Christchurch City Council and held at Lincoln University, provided an opportunity for Council to gain inspiration from the design and architecture industry, while testing the draft Central City Plan currently being developed. The Challenge was a response to the recent earthquakes in Christchurch and brought together local and international talent. A total of 15 teams took part in the Challenge, with seven people in each including engineers, planners, urban designers, architects and landscape architects, as well as one student on each team. The four sites within the Red Zone included the Cathedral Square and BNZ Building; 160 Gloucester Street; the Orion NZ Building at 203 Gloucester Street; and 90 Armagh Street, including the Avon River and Victoria Square. The fifth site, which sits outside the Red Zone, is the former Christchurch Women’s Hospital at 885 Colombo Street. This is team SoLA's entry for 160 Gloucester Street.
At 4.35 a.m. on the 4th of September 2010 Christchurch residents were shaken awake by a magnitude 7.1 earthquake, the largest earthquake to hit urban New Zealand for nearly 80 years. It was a large earthquake. On average the world only has 17 earthquakes a year larger than magnitude seven. Haiti’s earthquake in January 2010 was magnitude 7.1 and Chile’s earthquake in February was magnitude 8.8. Although it was a big quake, Christchurch was lucky. In Haiti’s earthquake over 230,000 people were killed and in Chile 40,000 homes were destroyed. Happily this was not the situation in Christchurch, however the earthquake has caused considerable damage. The challenge for the Landscape Architecture community is to contribute to the city’s reconstruction in ways that will not only fix the problems of housing, and the city’s urban, suburban and neighbourhood fabric but that will do so in ways that will help solve the landscape problems that dogged the city before the earthquake struck.
The University of Canterbury held its inaugural Earthquake Forum on the 2nd September 2011. It was an opportunity to hear the diversity of earthquake-related research currently being undertaken in Canterbury and a chance for researchers and those working on the recovery to identify further areas where the research can support the recovery effort.The morning consisted of presentations showcasing the breadth of research currently underway and the afternoon will create the opportunity for people to connect in a series of concurrent workshops on the land, buildings and people. Neil Challenger's presentation covers landscape architecture, temporary landscapes, exploration of design ideas and specific student research related to urban design and earthquake recovery.
On September the 4th 2010 and February 22nd 2011 the Canterbury region of New Zealand was shaken by two massive earthquakes. This paper is set broadly within the civil defence and emergency management literature and informed by recent work on community participation and social capital in the building of resilient cities. Work in this area indicates a need to recognise both the formal institutional response to the earthquakes as well as the substantive role communities play in their own recovery. The range of factors that facilitate or hinder community involvement also needs to be better understood. This paper interrogates the assumption that recovery agencies and officials are both willing and able to engage communities who are themselves willing and able to be engaged in accordance with recovery best practice. Case studies of three community groups – CanCERN, Greening the Rubble and Gap Filler – illustrate some of the difficulties associated with becoming a community during the disaster recovery phase. Based on my own observations and experiences, combined with data from approximately 50 in-depth interviews with Christchurch residents and representatives from community groups, the Christchurch City Council, the Earthquake Commission and so on, this paper outlines some practical strategies emerging communities may use in the early disaster recovery phase that then strengthens their ability to ‘participate’ in the recovery process.
Lincoln University and CBRE, a commercial real estate service provider, have conducted research to investigate the impacts of the Canterbury earthquake on the commercial office market in Christchurch. The 22 February 2011 Canterbury earthquake had a devastating impact on Christchurch property with significant damage caused to land and buildings. As at January 2012, around 740 buildings have either been demolished or identified to be demolished in central Christchurch. On top of this, around 140 buildings have either been partially demolished or identified to be partially demolished. The broad aims of our research are to (i) examine the nature and extent of the CBD office relocation, (ii) identify the nature of the occupiers, (iii) determine occupier’s perceptions of the future: their location and space needs post the February earthquake, and the likelihood of relocating back to the CBD after the rebuild, and (iv) find out what occupiers see as the future of the CBD, and how they want this to look.
There is a critical strand of literature suggesting that there are no ‘natural’ disasters (Abramovitz, 2001; Anderson and Woodrow, 1998; Clarke, 2008; Hinchliffe, 2004). There are only those that leave us – the people - more or less shaken and disturbed. There may be some substance to this; for example, how many readers recall the 7.8 magnitude earthquake centred in Fiordland in July 2009? Because it was so far away from a major centre and very few people suffered any consequences, the number is likely to be far fewer than those who remember (all too vividly) the relatively smaller 7.1 magnitude Canterbury quake of September 4th 2010 and the more recent 6.3 magnitude February 22nd 2011 event. One implication of this construction of disasters is that seismic events, like those in Canterbury, are as much socio-political as they are geological. Yet, as this paper shows, the temptation in recovery is to tick boxes and rebuild rather than recover, and to focus on hard infrastructure rather than civic expertise and community involvement. In this paper I draw upon different models of community engagement and use Putnam’s (1995) notion of ‘social capital’ to frame the argument that ‘building bridges’ after a disaster is a complex blend of engineering, communication and collaboration. I then present the results of a qualitative research project undertaken after the September 4th earthquake. This research helps to illustrate the important connections between technical rebuilding, social capital, recovery processes and overall urban resilience.
Implementing seismic risk mitigation is a major challenge in many earthquake prone regions. The objective of this research is to investigate how property investment market practices can be used to enhance building owners’ decisions to improve seismic performance of earthquake prone buildings (EPBs). A case study method adopted, revealed the impacts of the property market stakeholders’ practices on seismic retrofit decisions. The findings from this research provide significant new insights on how property market-based incentives such as such as mandatory disclosure of seismic risks in all transactions in the property market, effective awareness seismic risk program and a unified earthquake safety assessment information system, can be used to enhance EPBs owners seismic retrofit decisions. These market-based incentives offer compelling reasons for the different property market stakeholders and the public at large to retain, care, invest, and act responsibly to rehabilitate EPBs. The findings suggest need for stakeholders involved in property investment and retrofit decisions to work together to foster seismic rehabilitation of EPBs.
The focus of this paper is to identify potential benefits of community involvement in master planning in the post-earthquake recovery context in Christchurch; and to identify considerations for planners involved in the design of master planning processes that involve the community. Findings are based on the results of an information sharing event on these topics convened by The Habitat Project in December 2011, and a review of the relevant literature.
4th September 2010 a 7.1 magnitude earthquake strikes near Christchurch, New Zealand’s second largest city of approximately 370,000 people. This is followed by a 6.3 magnitude quake on 22nd February 2011 and a 6.4 on 13th June. In February 181 people died and a state of national emergency was declared from 23 February to 30th April. Urban Search and Rescue teams with 150 personnel from New Zealand and 429 from overseas worked tirelessly in addition to Army, Police and Fire services. Within the central business district 1,000 buildings (of 4,000) are expected to be demolished. An estimated 10,000 houses require demolition and over 100,000 were damaged. Meanwhile the over 7,000 aftershocks have become part of the “new normal” for us all. During this time how have libraries supported their staff? What changes have been made to services? What are the resourcing opportunities? This presentation will provide a personal view from Lincoln University, Te Whare Wanaka o Aoraki, Library Teaching and Learning. Lincoln is New Zealand's third oldest university having been founded in 1878. Publicly owned and operated it is New Zealand's specialist land-based university. Lincoln is based on the Canterbury Plains, 22 kilometres south of Christchurch. On campus there was mostly minor damage to buildings while in the Library 200,000 volumes were thrown from the shelves. I will focus on the experiences of the Disaster Team and on our experiences with hosting temporarily displaced staff and students from the Christchurch Polytechnic Institute of Technology, Library, Learning & Information Services. Experiences from two other institutions will be highlighted: Christchurch City Libraries, Ngā Kete Wānanga-o-Ōtautahi. Focusing on the Māori Services Team and the Ngā Pounamu Māori and Ngāi Tahu collections. The Central library located within the red zone cordon has been closed since February, the Central library held the Ngā Pounamu Māori and Ngai Tahu collections, the largest Māori collections in the Christchurch public library network. The lack of access to these collections changed the way the Māori Services Team, part of the larger Programmes, Events and Learning Team at Christchurch City Libraries were able to provide services to their community resulting in new innovative outreach programmes and a focus on promotion of online resources. On 19th December the “temporary” new and smaller Central library Peterborough opened. The retrieved Ngā Pounamu Māori and Ngai Tahu collections "Ngā rakau teitei e iwa”, have since been re-housed and are once again available for use by the public. Te Rūnanga o Ngāi Tahu. This organisation, established by the Te Rūnanga o Ngāi Tahu Act 1996, services the statutory rights for the people of Ngāi Tahu descent and ensures that the benefits of their Treaty Claim Settlement are enjoyed by Ngāi Tahu now and in the future. Ngāi Tahu are the indigenous Māori people of the southern islands of New Zealand - Te Waipounamu. The iwi (people) hold the rangatiratanga or tribal authority to over 80 per cent of the South Island. With their headquarters based in the central business they have also had to be relocated to temporary facilities. This included their library/archive collection of print resources, art works and taonga (cultural treasures).

Increasingly, economic, political and human crises, along with natural disasters, constitute a recurrent reality around the world. The effect of large-scale disaster and economic disruption are being felt far and wide and impacting libraries in diverse ways. Libraries are casualties of natural disasters, from earthquakes to hurricanes, as well as civil unrest and wars. Sudden cuts in library budgets have resulted in severe staff reductions, privatization and even closures. The presenters share their experiences about how they have prepared for or coped with profound change.
The Building Act 2004 now requires Territorial Authorities (TAs) to have in place a policy setting out how they intend making existing buildings that would be unable to withstand a moderate earthquake safe for their occupiers. Many of the resultant policies developed by TAs have put in place mandatory upgrade requirements that will force owners to expend large amounts of capital on seismic upgrading of their buildings. The challenge for the property owners and TAs alike is to make such development work economic or the result will be wide scale demolition of old buildings. This has serious implications for both heritage conservation and inner city revitalisation plans that are based on existing heritage buildings. This paper sets out the issues and challenges for the seismic upgrading of buildings in New Zealand and puts forward some potential solutions
The aftermath of three earthquakes has forced Christchurch to re-plan and rebuild. New perspectives of a sustainable city have arisen granting Christchurch the chance of becoming an example to the world. This work is centred on bioclimatic landscape design as a base for greening strategies. It deals with strategic landscape design adapted to a specific climate, from a user’s perspective. The investigation will be applied to Christchurch’s urban centres, assessing cultural adaptability to the local climate and implications for landscape design. Climatic data shows that humidity is not a local problem. However, the wind is the determinant. In Christchurch the solar radiation and the prevailing winds are the most important microclimatic variables, the latter intensifying the loss of surface heat, decreasing the radiant temperature and affecting thermal sensation. The research objective is to explore design parameters at the street-scale and identify ways to maximise thermal comfort in outdoor spaces through design-based strategies. The investigation will apply methods of participant observation, depth interviews, climatic data collection and design experimentation based on thermal comfort models and computer simulation tools. Case study sites chosen for investigation are places with current levels of activity that may be anticipated in the rebuild of the central city. The research will have two main outcomes: improved understanding of local urban culture adaptation to microclimate, and a demonstration of how design can enhance adaption. These outcomes will inform designers and city managers about good design practices and strategies that can be used to ensure a long term liveable city.
The recent earthquakes in Canterbury have left thousands of Christchurch residents’ homeless or facing the possibility of homelessness. The New Zealand Government, so far, have announced that 5,100 homes in Christchurch will have to be abandoned as a result of earthquake damaged land (Christchurch City Council, 2011). They have been zoned red on the Canterbury Earthquake Recovery Authority (CERA) map and there are another 10,000 that have been zoned orange, awaiting a decision (Christchurch City Council, 2011). This situation has placed pressures on land developers and local authorities to speed up the process associated with the development of proposed subdivisions in Christchurch to accommodate residents in this situation (Tarrant, 2011).
The topic of ‘resilience’ thinking seems of late to have superseded that of ‘sustainability’ thinking. Sustainability means simply that which sustains and lasts but has taken on many different subtle nuances over the last 20 years since it came into common parlance with the Bruntland Report of 1987, which sought to clarify the definition. However, resilience ‘speak’ has become hot property now, especially highlighted since Christchurch experienced a natural disaster in the form of several large earthquakes from Sep 2010 until most recently in December 2011. Many people comment on how resilient people have been, how resilient the city has been, so it seems timely to investigate what resilience actually means and importantly, resilient to what and of what? (Lorenz, 2010). This essay will look at the concept of systems and resilience, definitions and theories will be explored generally and then these concepts will be more closely defined within the context of a particular system, that of Somerfield School located in the western suburbs of Christchurch.
The devastating earthquakes of September 2010 and February 2011 have without question upset the Christchurch City way of life for all. Families and businesses, as well as the natural and built environments have been directly affected, and our social landscapes have since evolved to accommodate the visible changes. Though not perhaps seen as a priority, the Christchurch nightlife has been profoundly altered by the quakes and the once popular CBD clubbing scene has ceased to exist. The concern highlighted in this article is the way in which this has put pressure on suburban bars and the the implications of this for local residents.
