The Canterbury earthquakes of 2010 and 2011 generated hundreds of thousands of insurance claims, many of which were disputed. The New Zealand justice system faced the same challenge encountered by other jurisdictions following a natural disaster: how to resolve these disputes quickly and at minimal cost but also fairly, to avoid compounding the disaster with injustice? The thesis is of this article is that although the earthquakes were catastrophic for New Zealand, they also created a unique opportunity to design an innovative civil justice process—the Christchurch High Court Earthquake List—and to test, over a relatively short timeframe, how well that process works. This article describes the Christchurch High Court Earthquake List and analyses it by reference to civil justice theory about the relative normative values of public adjudication and private settlement and the dialogic relationship between them. It then evaluates the List, using statistics available five years on from the earthquakes and by reference to the author’s own experience mediating earthquake disputes.

New Zealand's devastating Canterbury earthquakes provided an opportunity to examine the efficacy of existing regulations and policies relevant to seismic strengthening of vulnerable buildings. The mixed-methods approach adopted, comprising both qualitative and quantitative approaches, revealed that some of the provisions in these regulations pose as constraints to appropriate strengthening of earthquake-prone buildings. Those provisions include the current seismic design philosophy, lack of mandatory disclosure of seismic risks and ineffective timeframes for strengthening vulnerable buildings. Recommendations arising from these research findings and implications for pre-disaster mitigation for future earthquake and Canterbury's post-disaster reconstruction suggest: (1) a reappraisal of the requirements for earthquake engineering design and construction, (2) a review and realignment of all regulatory frameworks relevant to earthquake risk mitigation, and (3) the need to develop a national programme necessary to achieve consistent mitigation efforts across the country. These recommendations are important in order to present a robust framework where New Zealand communities such as Christchurch can gradually recover after a major earthquake disaster, while planning for pre-disaster mitigation against future earthquakes. The 2010/2011 Canterbury earthquakes have provided a unique opportunity to investigate the seismic performance of both traditional and modern buildings constructed in New Zealand. It is critical that the observed performance is examined and compared against the expected levels of performance that are outlined by the Building Code and Design Standards. In particular, in recent years there has been a significant amount of research into the seismic behaviour of precast concrete floor systems and the robustness of the support connections as a building deforms during an earthquake. An investigation of precast concrete floor systems in Christchurch has been undertaken to assess both the performance of traditional and current design practice. The observed performance for each type of precast floor unit was collated from a number of post-earthquake recognisance activities and compared against the expected performance determined for previous experimental testing and analysis. Possible reasons for both the observed damage, and in some cases the lack of damage, were identified. This critical review of precast concrete floor systems will assist in determining the success of current design practice as well as identify any areas that require further research and/or changes to design standards.

The Global Earthquake Model’s (GEM) Earthquake Consequences Database (GEMECD) aims to develop, for the first time, a standardised framework for collecting and collating geocoded consequence data induced by primary and secondary seismic hazards to different types of buildings, critical facilities, infrastructure and population, and relate this data to estimated ground motion intensity via the USGS ShakeMap Atlas. New Zealand is a partner of the GEMECD consortium and to-date has contributed with 7 events to the database, of which 4 are localised in the South Pacific area (Newcastle 1989; Luzon 1990; South of Java 2006 and Samoa Islands 2009) and 3 are NZ-specific events (Edgecumbe 1987; Darfield 2010 and Christchurch 2011). This contribution to GEMECD represented a unique opportunity for collating, comparing and reviewing existing damage datasets and harmonising them into a common, openly accessible and standardised database, from where the seismic performance of New Zealand buildings can be comparatively assessed. This paper firstly provides an overview of the GEMECD database structure, including taxonomies and guidelines to collect and report on earthquake-induced consequence data. Secondly, the paper presents a summary of the studies implemented for the 7 events, with particular focus on the Darfield (2010) and Christchurch (2011) earthquakes. Finally, examples of specific outcomes and potentials for NZ from using and processing GEMECD are presented, including: 1) the rationale for adopting the GEM taxonomy in NZ and any need for introducing NZ-specific attributes; 2) a complete overview of the building typological distribution in the Christchurch CBD prior to the Canterbury earthquakes and 3) some initial correlations between the level and extent of earthquake-induced physical damage to buildings, building safety/accessibility issues and the induced human casualties.

As part of a seismic retrofit scheme, surface bonded glass fiber-reinforced polymer (GFRP) fabric was applied to two unreinforced masonry (URM) buildings located in Christchurch, New Zealand. The unreinforced stone masonry of Christchurch Girls’ High School (GHS) and the unreinforced clay brick masonry Shirley Community Centre were retrofitted using surface bonded GFRP in 2007 and 2009, respectively. Much of the knowledge on the seismic performance of GFRP retrofitted URM was previously assimilated from laboratory-based experimental studies with controlled environments and loading schemes. The 2010/2011 Canterbury earthquake sequence provided a rare opportunity to evaluate the GFRP retrofit applied to two vintage URM buildings and to document its performance when subjected to actual design-level earthquake-induced shaking. Both GFRP retrofits were found to be successful in preserving architectural features within the buildings as well as maintaining the structural integrity of the URM walls. Successful seismic performance was based on comparisons made between the GFRP retrofitted GHS building and the adjacent nonretrofitted Boys’ High School building, as well as on a comparison between the GFRP retrofitted and nonretrofitted walls of the Shirley Community Centre building. Based on detailed postearthquake observations and investigations, the GFRP retrofitted URM walls in the subject buildings exhibited negligible to minor levels of damage without delamination, whereas significant damage was observed in comparable nonretrofitted URM walls. Following the 2010/2011 Canterbury earthquakes a detailed campaign of door to door assessments was conducted in a variety of areas of Christchurch to establish the earthquake performance of residential dwellings having masonry veneer as an external cladding attached to a lightweight timber framing system. Specifically, care was taken to include regions of Christchurch which experienced different levels of earthquake shaking in order to allow comparison between the performance of different systems and different shaking intensities. At the time of the inspections the buildings in the Christchurch region had been repeatedly subjected to large earthquakes, presenting an opportunity for insight into the seismic performance of masonry veneer cladding. In total just under 1100 residential dwellings were inspected throughout the wider Christchurch area, of which 24% were constructed using the older nail-on veneer tie system (prior to 1996) and 76% were constructed using screw fixed ties to comply with the new 1996 standards revision (post-1996), with 30% of all inspected houses being of two storey construction. Of the inspected dwellings 27% had some evidence of liquefaction, ground settlement or lateral spreading. Data such as damage level, damage type, crack widths, level of repair required and other parameters were collected during the survey. Following the devastation of the Canterbury earthquake sequence a unique opportunity exists to rebuild and restructure the city of Christchurch, ensuring that its infrastructure is constructed better than before and is innovative. By installing an integrated grid of modern sensor technologies into concrete structures during the rebuild of the Christchurch CBD, the aim is to develop a network of self-monitored ‘digital buildings’. A diverse range of data will be recorded, potentially including parameters such as concrete stresses, strains, thermal deformations, acoustics and the monitoring of corrosion of reinforcement bars. This procedure will allow an on-going complete assessment of the structure’s performance and service life, both before and after seismic activity. The data generated from the embedded and surface mounted sensors will be analysed to allow an innovative and real-time health monitoring solution where structural integrity is continuously known. This indication of building performance will allow the structure to alert owners, engineers and asset managers of developing problems prior to failure thresholds being reached. A range of potential sensor technologies for monitoring the performance of existing and newly constructed concrete buildings is discussed. A description of monitoring work conducted on existing buildings during the July 2013 Cook Strait earthquake sequence is included, along with details of current work that investigates the performance of sensing technologies for detecting crack formation in concrete specimens. The potential market for managing the real-time health of installed infrastructure is huge. Civil structures all over the world require regular visual inspections in order to determine their structural integrity. The information recorded during the Christchurch rebuild will generate crucial data sets that will be beneficial in understanding the behaviour of concrete over the complete life cycle of the structure, from construction through to operation and building repairs until the time of failure. Soil Liquefaction during Recent Large-Scale Earthquakes contains selected papers presented at the New Zealand – Japan Workshop on Soil Liquefaction during Recent Large-Scale Earthquakes (Auckland, New Zealand, 2-3 December 2013). The 2010-2011 Canterbury earthquakes in New Zealand and the 2011 off the Pacific Coast of Tohoku Earthquake in Japan have caused significant damage to many residential houses due to varying degrees of soil liquefaction over a very wide extent of urban areas unseen in past destructive earthquakes. While soil liquefaction occurred in naturally-sedimented soil formations in Christchurch, most of the areas which liquefied in Tokyo Bay area were reclaimed soil and artificial fill deposits, thus providing researchers with a wide range of soil deposits to characterize soil and site response to large-scale earthquake shaking. Although these earthquakes in New Zealand and Japan caused extensive damage to life and property, they also serve as an opportunity to understand better the response of soil and building foundations to such large-scale earthquake shaking. With the wealth of information obtained in the aftermath of both earthquakes, information-sharing and knowledge-exchange are vital in arriving at liquefaction-proof urban areas in both countries. Data regarding the observed damage to residential houses as well as the lessons learnt are essential for the rebuilding efforts in the coming years and in mitigating buildings located in regions with high liquefaction potential. The quality of multi-owned residential buildings and the capability to maintain that quality into the future is important in preserving not only the monetary value of such housing (Lujanen, 2010) but also the quality of life for its residents. The aim of this paper is to examine the governance and decision-making rules and regulations as they relate to the undertaking of major repairs in multi-owned residential buildings in Finland and New Zealand with particular regard to the Finnish Limited Liability Housing Companies Act 2010 (LLHCA 2010) and the New Zealand Unit Titles Act 2010 (UTA 2010). Currently, major building repairs are topical issues in both countries; in Finland as a result of ageing buildings requiring major re-fitting of pipes and other infrastructure, and in New Zealand as a result of earthquake damage in Christchurch and Leaky Building Syndrome nationwide. Major repairs can be a significant financial burden to unit owners and collective decisions can be difficult to achieve. Interestingly, new legislation that governs multi-owned housing was enacted in both countries in 2010. The recent enactment of this legislation provides an opportunity to examine the UTA 2010 and LLHCA 2010 with regard to how they address major repairs, improvements in housing stock and the financing possibilities associated with these undertakings. More specifically this paper explores housing intensification (i.e. building up, out or alongside existing multi-owned residential buildings on commonly owned land) as a means of financing major repairs. The comparison of governance and decision-making in two different shared ownership systems with different histories and cultural contexts provides a chance to explore the possibilities and challenges that each country faces, and the potential to learn from each other’s practices and develop these further. In this regard the findings from this paper contribute to the academic literature (Bugden 2005; Easthope & Randolph 2009; Dupuis & Dixon 2010; Lujanen 2010; Easthope, Hudson & Randolph 2013) concerning to the governance of multi-owned housing as it relates to intensive housing development and its wider social and economic implications.
