This article argues that teachers deserve more recognition for their roles as first responders in the immediate aftermath of a disaster and for the significant role they play in supporting students and their families through post-disaster recovery. The data are drawn from a larger study, 'Christchurch Schools Tell Their Earthquake Stories' funded by the United Nations Educational, Scientific and Cultural Organisation and the University of Auckland, in which schools were invited to record their earthquake stories for themselves and for historical archives. Data were gathered from five primary schools between 2012 and 2014. Methods concerned mainly semi-structured individual or group interviews and which were analysed thematically. The approach was sensitive, flexible and participatory with each school being able to choose its focus, participants and outcome. Participants from each school generally included the principal and a selection of teachers, students and parents. In this study, the data relating to the roles of teachers were separated out for closer analysis. The findings are presented as four themes: immediate response; returning to (new) normal; care and support; and long term effects.
Churches are an important part of New Zealand's historical and architectural heritage. Various earthquakes around the world have highlighted the significant seismic vulnerability of religious buildings, with the extensive damage that occurred to stone and clay-brick unreinforced masonry churches after the 2010-2011 Canterbury earthquakes emphasising the necessity to better understand this structural type. Consequently, a country-wide inventory of unreinforced masonry churches is here identified. After a bibliographic and archival investigation, and a 10 000 km field trip, it is estimated that currently 297 unreinforced masonry churches are present throughout New Zealand, excluding 12 churches demolished in Christchurch because of heavy damage sustained during the Canterbury earthquake sequence. The compiled database includes general information about the buildings, their architectural features and structural characteristics, and any architectural and structural transformations that have occurred in the past. Statistics about the occurrence of each feature are provided and preliminary interpretations of their role on seismic vulnerability are discussed. The list of identified churches is reported in annexes, supporting their identification and providing their address.
This thesis presents an assessment of historic seismic performance of the New Zealand stopbank network from the 1968 Inangahua earthquake through to the 2016 Kaikōura earthquake. An overview of the types of stopbanks and the main aspects of the design and construction of earthen stopbanks was presented. Stopbanks are structures that are widely used on the banks of rivers and other water bodies to protect against the impact of flood events. Earthen stopbanks are found to be the most used for such protection measures. Different stopbank damage or failure modes that may occur due to flooding or earthquake excitation were assessed with a focus on past earthquakes internationally, and examples of these damage and failure modes were presented. Stopbank damage and assessment reports were collated from available reconnaissance literature to develop the first geospatial database of stopbank damage observed in past earthquakes in New Zealand. Damage was observed in four earthquakes over the past 50 years, with a number of earthquakes resulting in no stopbank damage. The damage database therefore focussed on the Edgecumbe, Darfield, Christchurch and Kaikōura earthquakes. Cracking of the crest and liquefaction-induced settlement were the most common forms of damage observed. To understand the seismic demand on the stopbank network in past earthquakes, geospatial analyses were undertaken to approximate the peak ground acceleration (PGA) across the stopbank network for ten large earthquakes that have occurred in New Zealand over the past 50 years. The relationship between the demand, represented by the peak ground acceleration (PGA) and damage is discussed and key trends identified. Comparison of the seismic demand and the distribution of damage suggested that the seismic performance of the New Zealand stopbank network has been generally good across all events considered. Although a significant length of the stopbank networks were exposed to high levels of shaking in past events, the overall damage length was a small percentage of this. The key aspect controlling performance was the performance of the underlying foundation soils and the effect of this on the stopbank structure and stability.
Following the 2010/2011 Canterbury earthquakes the seismic design of buildings with precast concrete panels has received significant attention. Although this form of construction generally performed adequately in Christchurch, there were a considerable number of precast concrete panel connection failures. This observation prompted a review of more than 4700 panel details from 108 buildings to establish representative details used in both existing and new multi-storey and low rise industrial precast concrete buildings in three major New Zealand cities of Auckland, Wellington and Christchurch. Details were collected from precast manufacturers and city councils and were categorised according to type. The detailing and quantity of each reviewed connection type in the sampled data is reported, and advantages and potential deficiencies of each connection type are discussed. Background Liquefaction induced land damage has been identified in more than 13 notable New Zealand earthquakes within the past 150 years, as presented on the timeline below. Following the 2010-2011 Canterbury Earthquake Sequence (CES), the consequences of liquefaction were witnessed first-hand in the city of Christchurch and as a result the demand for understanding this phenomenon was heightened. Government, local councils, insurers and many other stakeholders are now looking to research and understand their exposure to this natural hazard.
Nowadays the telecommunication systems’ performance has a substantial impact on our lifestyle. Their operationality becomes even more substantial in a post-disaster scenario when these services are used in civil protection and emergency plans, as well as for the restoration of all the other critical infrastructure. Despite the relevance of loss of functionality of telecommunication networks on seismic resilience, studies on their performance assessment are few in the literature. The telecommunication system is a distributed network made up of several components (i.e. ducts, utility holes, cabinets, major and local exchanges). Given that these networks cover a large geographical area, they can be easily subjected to the effects of a seismic event, either the ground shaking itself, or co-seismic events such as liquefaction and landslides. In this paper, an analysis of the data collected after the 2010-2011 Canterbury Earthquake Sequence (CES) and the 2016 Kaikoura Earthquake in New Zealand is conducted. Analysing these data, information gaps are critically identified regarding physical and functional failures of the telecommunication components, the timeline of repair/reconstruction activities and service recovery, geotechnical tests and land planning maps. Indeed, if these missing data were presented, they could aid the assessment of the seismic resilience. Thus, practical improvements in the post-disaster collection from both a network and organisational viewpoints are proposed through consultation of national and international researchers and highly experienced asset managers from Chorus. Finally, an outline of future studies which could guide towards a more resilient seismic performance of the telecommunication network is presented.
The M7.1 Darfield earthquake shook the town of Christchurch (New Zealand) in the early morning on Saturday 4th September 2010 and caused damage to a number of heritage unreinforced masonry buildings. No fatalities were reported directly linked to the earthquake, but the damage to important heritage buildings was the most extensive to have occurred since the 1931 Hawke‟s Bay earthquake. In general, the nature of damage was consistent with observations previously made on the seismic performance of unreinforced masonry buildings in large earthquakes, with aspects such as toppled chimneys and parapets, failure of gables and poorly secured face-loaded walls, and in-plane damage to masonry frames all being extensively documented. This report on the performance of the unreinforced masonry buildings in the 2010 Darfield earthquake provides details on typical building characteristics, a review of damage statistics obtained by interrogating the building assessment database that was compiled in association with post-earthquake building inspections, and a review of the characteristic failure modes that were observed.
This paper presents the preliminary conclusions of the first stage of Wellington Case Study project (Regulating For Resilience in an Earthquake Vulnerable City) being undertaken by the Disaster Law Research Group at the University of Canterbury Law School. This research aims to map the current regulatory environment around improving the seismic resilience of the urban built environment. This work provides the basis for the second stage of the project which will map the regulatory tools onto the reality of the current building stock in Wellington. Using a socio-legal methodology, the current research examines the regulatory framework around seismic resilience for existing buildings in New Zealand, with a particularly focus on multi-storey in the Wellington CBD. The work focusses both on the operation and impact of the formal seismic regulatory tools open to public regulators (under the amended Building Act) as other non-seismic regulatory tools. As well as examining the formal regulatory frame, the work also provides an assessment of the interactions between other non-building acts (such as Health and Safety at Work Act 2015) on the requirements of seismic resilience. Other soft-law developments (particularly around informal building standards) are also examined. The final output of this work will presents this regulatory map in a clear and easily accessible manner and provide an assessment of the suitability of this at times confusing and patchy legal environment as Wellington moves towards becoming a resilient city. The final conclusion of this work will be used to specifically examine the ability of Wellington to make this transition under the current regulatory environment as phase two of the Wellington Case Study project.
Unreinforced masonry churches in New Zealand, similarly to everywhere else in the word have proven to be highly vulnerable to earthquakes, because of their particular construction features. The Canterbury (New Zealand) earthquake sequence, 2010-2011 caused an invaluable loss of local architectural heritage and of churches, as regrettably, some of them were demolished instead of being repaired. It is critical for New Zealand to advance the data collection, research and understanding pertaining to the seismic performance and protection of church buildings, with the aim to:
The Global Earthquake Model’s (GEM) Earthquake Consequences Database (GEMECD) aims to develop, for the first time, a standardised framework for collecting and collating geocoded consequence data induced by primary and secondary seismic hazards to different types of buildings, critical facilities, infrastructure and population, and relate this data to estimated ground motion intensity via the USGS ShakeMap Atlas. New Zealand is a partner of the GEMECD consortium and to-date has contributed with 7 events to the database, of which 4 are localised in the South Pacific area (Newcastle 1989; Luzon 1990; South of Java 2006 and Samoa Islands 2009) and 3 are NZ-specific events (Edgecumbe 1987; Darfield 2010 and Christchurch 2011). This contribution to GEMECD represented a unique opportunity for collating, comparing and reviewing existing damage datasets and harmonising them into a common, openly accessible and standardised database, from where the seismic performance of New Zealand buildings can be comparatively assessed. This paper firstly provides an overview of the GEMECD database structure, including taxonomies and guidelines to collect and report on earthquake-induced consequence data. Secondly, the paper presents a summary of the studies implemented for the 7 events, with particular focus on the Darfield (2010) and Christchurch (2011) earthquakes. Finally, examples of specific outcomes and potentials for NZ from using and processing GEMECD are presented, including: 1) the rationale for adopting the GEM taxonomy in NZ and any need for introducing NZ-specific attributes; 2) a complete overview of the building typological distribution in the Christchurch CBD prior to the Canterbury earthquakes and 3) some initial correlations between the level and extent of earthquake-induced physical damage to buildings, building safety/accessibility issues and the induced human casualties.
This paper shows an understanding of the availability of resources in post-disaster reconstruction and recovery in Christchurch, New Zealand following its September 4, 2010 and February 22, 2011 earthquakes. Overseas experience in recovery demonstrates how delays and additional costs may incur if the availability of resources is not aligned with the reconstruction needs. In the case of reconstruction following Christchurch earthquakes, access to normal resource levels will be insufficient. An on-line questionnaire survey, combined with in-depth interviews was used to collect data from the construction professionals that had been participated in the post-earthquake reconstruction. The study identified the resources that are subject to short supply and resourcing challenges that are currently faced by the construction industry. There was a varied degree of impacts felt by the surveyed organisations from resource shortages. Resource pressures were primarily concentrated on human resources associated with structural, architectural and land issues. The challenges that may continue playing out in the longer-term reconstruction of Christchurch include limited capacity of the construction industry, competition for skills among residential, infrastructure and commercial sectors, and uncertainties with respect to decision making. Damage distribution maps from strong earthquakes and recorded data from field experiments have repeatedly shown that the ground surface topography and subsurface stratigraphy play a decisive role in shaping the ground motion characteristics at a site. Published theoretical studies qualitatively agree with observations from past seismic events and experiments; quantitatively, however, they systematically underestimate the absolute level of topographic amplification up to an order of magnitude or more in some cases. We have hypothesized in previous work that this discrepancy stems from idealizations of the geometry, material properties, and incident motion characteristics that most theoretical studies make. In this study, we perform numerical simulations of seismic wave propagation in heterogeneous media with arbitrary ground surface geometry, and compare results with high quality field recordings from a site with strong surface topography. Our goal is to explore whether high-fidelity simulations and realistic numerical models can – contrary to theoretical models – capture quantitatively the frequency and amplitude characteristics of topographic effects. For validation, we use field data from a linear array of nine portable seismometers that we deployed on Mount Pleasant and Heathcote Valley, Christchurch, New Zealand, and we compute empirical standard spectral ratios (SSR) and single-station horizontal-to-vertical spectral ratios (HVSR). The instruments recorded ambient vibrations and remote earthquakes for a period of two months (March-April 2017). We next perform two-dimensional wave propagation simulations using the explicit finite difference code FLAC. We construct our numerical model using a high-resolution (8m) Digital Elevation Map (DEM) available for the site, an estimated subsurface stratigraphy consistent with the geomorphology of the site, and soil properties estimated from in-situ and non-destructive tests. We subject the model to in-plane and out-of-plane incident motions that span a broadband frequency range (0.1-20Hz). Numerical and empirical spectral ratios from our blind prediction are found in very good quantitative agreement for stations on the slope of Mount Pleasant and on the surface of Heathcote Valley, across a wide range of frequencies that reveal the role of topography, soil amplification and basin edge focusing on the distribution of ground surface motion.
The 2010–2011 Canterbury earthquakes, which involved widespread damage during the February 2011 event and ongoing aftershocks near the Christchurch Central Business District, left this community with more than $NZD 40 billion in losses (~20 % GDP), demolition of approximately 60 % of multi-storey concrete buildings (3 storeys and up), and closure of the core business district for over 2 years. The aftermath of the earthquake sequence has revealed unique issues and complexities for the owners of commercial and multi-storey residential buildings in relation to unexpected technical, legal, and financial challenges when making decisions regarding the future of their buildings impacted by the earthquakes. The paper presents a framework to understand the factors influencing post-earthquake decisions (repair or demolish) on multi-storey concrete buildings in Christchurch. The study, conducted in 2014, includes in-depth investigations on 15 case-study buildings using 27 semi-structured interviews with various property owners, property managers, insurers, engineers, and government authorities in New Zealand. The interviews revealed insights regarding the multitude of factors influencing post-earthquake decisions and losses. As expected, the level of damage and repairability (cost to repair) generally dictated the course of action. There is strong evidence, however, that other variables have significantly influenced the decision on a number of buildings, such as insurance, business strategies, perception of risks, building regulations (and compliance costs), and government decisions. The decision-making process for each building is complex and unique, not solely driven by structural damage. Furthermore, the findings have put the spotlight on insurance policy wordings and the paradoxical effect of insurance on the recovery of Christchurch, leading to other challenges and issues going forward.
The Canterbury earthquakes of 2010 and 2011 generated hundreds of thousands of insurance claims, many of which were disputed. The New Zealand justice system faced the same challenge encountered by other jurisdictions following a natural disaster: how to resolve these disputes quickly and at minimal cost but also fairly, to avoid compounding the disaster with injustice? The thesis is of this article is that although the earthquakes were catastrophic for New Zealand, they also created a unique opportunity to design an innovative civil justice process—the Christchurch High Court Earthquake List—and to test, over a relatively short timeframe, how well that process works. This article describes the Christchurch High Court Earthquake List and analyses it by reference to civil justice theory about the relative normative values of public adjudication and private settlement and the dialogic relationship between them. It then evaluates the List, using statistics available five years on from the earthquakes and by reference to the author’s own experience mediating earthquake disputes.
Utility managers are always looking for appropriate tools to estimate seismic damage in wastewater networks located in earthquake prone areas. Fragility curves, as an appropriate tool, are recommended for seismic vulnerability analysis of buried pipelines, including pressurised and unpressurised networks. Fragility curves are developed in pressurised networks mainly for water networks. Fragility curves are also recommended for seismic analysis in unpressurised networks. Applying fragility curves in unpressurised networks affects accuracy of seismic damage estimation. This study shows limitations of these curves in unpressurised networks. Multiple case study analysis was applied to demonstrate the limitations of the application of fragility curves in unpressurised networks in New Zealand. Four wastewater networks within New Zealand were selected as case studies and various fragility curves used for seismic damage estimation. Observed damage in unpressurised networks after the 2007 earthquake in Gisborne and the 2010 earthquake in Christchurch demonstrate the appropriateness of the applied fragility curves to New Zealand wastewater networks. This study shows that the application of fragility curves, which are developed from pressurised networks, cannot be accurately used for seismic damage assessment in unpressurised wastewater networks. This study demonstrated the effects of different parameters on seismic damage vulnerability of unpressurised networks.

What constitutes good governance and successful recovery in these circumstances? This question is discussed in relation to two recent recovery processes. Sri Lanka has, for all intents and purposes, recovered from the tsunami that struck there and other parts of southern Asia in 2004. Christchurch, New Zealand was devastated by a sequence of earthquakes during 2010 and 2011 and recovery there is now well under way. The paper discusses the governance structures that have guided these two recoveries. While it is understood that the effects of disasters could potentially be life long and recovery from them complex, compatibility of the process and outcomes in relation to cultural norms and the critical issue of housing are the key issues discussed across the two cases.
The latest two great earthquake sequences; 2010- 2011 Canterbury Earthquake and 2016 Kaikoura Earthquake, necessitate a better understanding of the New Zealand seismic hazard condition for new building design and detailed assessment of existing buildings. It is important to note, however, that the New Zealand seismic hazard map in NZS 1170.5.2004 is generalised in effort to cover all of New Zealand and limited to a earthquake database prior to 2001. This is “common” that site-specific studies typically provide spectral accelerations different to those shown on the national map (Z values in NZS 1170.5:2004); and sometimes even lower. Moreover, Section 5.2 of Module 1 of the Earthquake Geotechnical Engineering Practice series provide the guidelines to perform site- specific studies.
Following the devastating 1931 Hawke's Bay earthquake, buildings in Napier and surrounding areas in the Hawke's Bay region were rebuilt in a comparatively homogenous structural and architectural style comprising the region's famous Art Deco stock. These interwar buildings are most often composed of reinforced concrete two-way space frames, and although they have comparatively ductile detailing for their date of construction, are often expected to be brittle, earthquake-prone buildings in preliminary seismic assessments. Furthermore, the likelihood of global collapse of an RC building during a design-level earthquake became an issue warranting particular attention following the collapse of multiple RC buildings in the February 22, 2011 Christchurch earthquake. Those who value the architectural heritage and future use of these iconic Art Deco buildings - including building owners, tenants, and city officials, among others - must consider how they can be best preserved and utilized functionally given the especially pressing implications of relevant safety, regulatory, and economic factors. This study was intended to provide information on the seismic hazard, geometric weaknesses, collapse hazards, material properties, structural detailing, empirically based vulnerability, and recommended analysis approaches particular to Art Deco buildings in Hawke's Bay as a resource for professional structural engineers tasked with seismic assessments and retrofit designs for these buildings. The observed satisfactory performance of similar low-rise, ostensibly brittle RC buildings in other earthquakes and the examination of the structural redundancy and expected column drift capacities in these buildings, led to the conclusion that the seismic capacity of these buildings is generally underrated in simple, force-based assessments.
The author followed five primary (elementary) schools over three years as they responded to and began to recover from the 2010–2011 earthquakes in and around the city of Christchurch in the Canterbury region of New Zealand. The purpose was to capture the stories for the schools themselves, their communities, and for New Zealand’s historical records. From the wider study, data from the qualitative interviews highlighted themes such as children’s responses or the changing roles of principals and teachers. The theme discussed in this article, however, is the role that schools played in the provision of facilities and services to meet (a) physical needs (food, water, shelter, and safety); and (b) emotional, social, and psychological needs (communication, emotional support, psychological counseling, and social cohesion)—both for themselves and their wider communities. The role schools played is examined across the immediate, short-, medium-, and long-term response periods before being discussed through a social bonding theoretical lens. A large number of businesses that used to be in the centre of Christchurch relocated after the earthquakes. Are they satisfied with their new locations and do they intend to return to the central city? We questioned 209 relocated businesses about their relocation history, present circumstances and future intentions. Many businesses were content with their new premises, despite having encountered a range of problems; those businesses that were questioned later in our survey period were more content. The average business in our sample rated the chances of moving back to the central city as around 50 %, but this varies with the type of business. Building height did not emerge as a major issue, but rents may be. The mix of types of business is likely to be different in the new city centre.
These research papers explore the concept of vulnerability in international human rights law. In the wake of the Christchurch earthquakes of 2010-2011, this research focuses on how "vulnerability" has been used and developed within the wider human rights discourse. They also examine jurisprudence of international human rights bodies, and how the concept of "vulnerability" has been applied. The research also includes a brief investigation into the experiences of vulnerable populations in disaster contexts, focusing primarily on the experiences of "vulnerable persons" in the Christchurch earthquakes and their aftermath.
In response to the February 2011 earthquake, Parliament enacted the Canterbury Earthquake Recovery Act. This emergency legislation provided the executive with extreme powers that extended well beyond the initial emergency response and into the recovery phase. Although New Zealand has the Civil Defence Emergency Management Act 2002, it was unable to cope with the scale and intensity of the Canterbury earthquake sequence. Considering the well-known geological risk facing the Wellington region, this paper will consider whether a standalone “Disaster Recovery Act” should be established to separate an emergency and its response from the recovery phase. Currently, Government policy is to respond reactively to a disaster rather than proactively. In a major event, this typically involves the executive being given the ability to make rules, regulations and policy without the delay or oversight of normal legislative process. In the first part of this paper, I will canvas what a “Disaster Recovery Act” could prescribe and why there is a need to separate recovery from emergency. Secondly, I will consider the shortfalls in the current civil defence recovery framework which necessitates this kind of heavy governmental response after a disaster. In the final section, I will examine how
PurposeThe purpose of this research is to highlight the role of not-for-profit (NFP) organisations in enhancing disaster preparedness. The authors set out to understand their perspectives and practices in regard to disaster preparedness activities to support people who live precarious lives, especially those who live as single parents who are the least prepared for disasters.Design/methodology/approachThe research draws on in-depth, semi-structured interviews with 12 staff members, either in a group setting or individually, from seven NFP organisations, who were located in Ōtautahi (Christchurch) and Kaiapoi in Aotearoa New Zealand. These participants were interviewed eight years after the 2011 Christchurch earthquake.FindingsFour key narrative tropes or elements were drawn from across the interviews and were used to structure the research results. These included: “essential” support services for people living precarious lives; assisting people to be prepared; potential to support preparedness with the right materials and relationships; resourcing to supply emergency goods.Originality/valueThis research contributes to disaster risk reduction practices by advocating for ongoing resourcing of NFP groups due to their ability to build a sense of community and trust while working with precarious communities, such as single parents.
Following the magnitude 6.3 aftershock in Christchurch, New Zealand, on 22 February 2011, a number of researchers were sent to Christchurch as part of the New Zealand Natural Hazard Research Platform funded “Project Masonry” Recovery Project. Their goal was to document and interpret the damage to the masonry buildings and churches in the region. Approximately 650 unreinforced and retrofitted clay brick masonry buildings in the Christchurch area were surveyed for commonly occurring failure patterns and collapse mechanisms. The entire building stock of Christchurch, and in particular the unreinforced masonry building stock, is similar to that in the rest of New Zealand, Australia, and abroad, so the observations made here are relevant for the entire world.
Liquefaction-induced lateral spreading during earthquakes poses a significant hazard to the built environment, as observed in Christchurch during the 2010 to 2011 Canterbury Earthquake Sequence (CES). It is critical that geotechnical earthquake engineers are able to adequately predict both the spatial extent of lateral spreads and magnitudes of associated ground movements for design purposes. Published empirical and semi-empirical models for predicting lateral spread displacements have been shown to vary by a factor of <0.5 to >2 from those measured in parts of Christchurch during CES. Comprehensive post- CES lateral spreading studies have clearly indicated that the spatial distribution of the horizontal displacements and extent of lateral spreading along the Avon River in eastern Christchurch were strongly influenced by geologic, stratigraphic and topographic features.
Terminus calving of icebergs is a common mass-loss mechanism from water-terminating glaciers globally, including the lake-calving glaciers in New Zealand’s central Southern Alps. Calving rates can increase dramatically in response to increases in ice velocity and/or retreat of the glacier margin. Here, we describe a large calving event (c. 4.5 × 106 m3) observed at Tasman Glacier, which initiated around 30 min after the MW 6.2 Christchurch earthquake of 22 February 2011. The volume of this calving event was equalled or exceeded only once in a subsequent 13-month-long study. While the temporal association with the earthquake remains intriguing, the effects of any preconditioning factors remain unclear.
he 2016 Building (Earthquake Prone Building) Amendment Act aims to improve the system for managing earthquake-prone buildings. The proposed changes to the Act were precipitated by the Canterbury earthquakes, and the need to improve the seismic safety of New Zealand’s building stock. However, the Act has significant ramifications for territorial authorities, organisations and individuals in small New Zealand towns, since assessing and repairing heritage buildings poses a major cost to districts with low populations and poor rental returns on commercial buildings.
In September 2010 and February 2011 the Canterbury region of New Zealand was struck by two powerful earthquakes, registering magnitude 7.1 and 6.3 respectively on the Richter scale. The second earthquake was centred 10 kilometres south-east of the centre of Christchurch (the region’s capital and New Zealand’s third most populous urban area, with approximately 360,000 residents) at a depth of five kilometres. 185 people were killed, making it the second deadliest natural disaster in New Zealand’s history. (66 people were killed in the collapse of one building alone, the six-storey Canterbury Television building.) The earthquake occurred during the lunch hour, increasing the number of people killed on footpaths and in buses and cars by falling debris. In addition to the loss of life, the earthquake caused catastrophic damage to both land and buildings in Christchurch, particularly in the central business district. Many commercial and residential buildings collapsed in the tremors; others were damaged through soil liquefaction and surface flooding. Over 1,000 buildings in the central business district were eventually demolished because of safety concerns, and an estimated 70,000 people had to leave the city after the earthquakes because their homes were uninhabitable. The New Zealand Government declared a state of national emergency, which stayed in force for ten weeks. In 2014 the Government estimated that the rebuild process would cost NZ$40 billion (approximately US$27.3 billion, a cost equivalent to 17% of New Zealand’s annual GDP). Economists now estimate it could take the New Zealand economy between 50 and 100 years to recover. The earthquakes generated tens of thousands of insurance claims, both against private home insurance companies and against the New Zealand Earthquake Commission, a government-owned statutory body which provides primary natural disaster insurance to residential property owners in New Zealand. These ranged from claims for hundreds of millions of dollars concerning the local port and university to much smaller claims in respect of the thousands of residential homes damaged. Many of these insurance claims resulted in civil proceedings, caused by disputes about policy cover, the extent of the damage and the cost and/or methodology of repairs, as well as failures in communication and delays caused by the overwhelming number of claims. Disputes were complicated by the fact that the Earthquake Commission provides primary insurance cover up to a monetary cap, with any additional costs to be met by the property owner’s private insurer. Litigation funders and non-lawyer claims advocates who took a percentage of any insurance proceeds also soon became involved. These two factors increased the number of parties involved in any given claim and introduced further obstacles to resolution. Resolving these disputes both efficiently and fairly was (and remains) central to the rebuild process. This created an unprecedented challenge for the justice system in Christchurch (and New Zealand), exacerbated by the fact that the Christchurch High Court building was itself damaged in the earthquakes, with the Court having to relocate to temporary premises. (The High Court hears civil claims exceeding NZ$200,000 in value (approximately US$140,000) or those involving particularly complex issues. Most of the claims fell into this category.) This paper will examine the response of the Christchurch High Court to this extraordinary situation as a case study in innovative judging practices and from a jurisprudential perspective. In 2011, following the earthquakes, the High Court made a commitment that earthquake-related civil claims would be dealt with as swiftly as the Court's resources permitted. In May 2012, it commenced a special “Earthquake List” to manage these cases. The list (which is ongoing) seeks to streamline the trial process, resolve quickly claims with precedent value or involving acute personal hardship or large numbers of people, facilitate settlement and generally work proactively and innovatively with local lawyers, technical experts and other stakeholders. For example, the Court maintains a public list (in spreadsheet format, available online) with details of all active cases before the Court, listing the parties and their lawyers, summarising the facts and identifying the legal issues raised. It identifies cases in which issues of general importance have been or will be decided, with the expressed purpose being to assist earthquake litigants and those contemplating litigation and to facilitate communication among parties and lawyers. This paper will posit the Earthquake List as an attempt to implement innovative judging techniques to provide efficient yet just legal processes, and which can be examined from a variety of jurisprudential perspectives. One of these is as a case study in the well-established debate about the dialogic relationship between public decisions and private settlement in the rule of law. Drawing on the work of scholars such as Hazel Genn, Owen Fiss, David Luban, Carrie Menkel-Meadow and Judith Resnik, it will explore the tension between the need to develop the law through the doctrine of precedent and the need to resolve civil disputes fairly, affordably and expeditiously. It will also be informed by the presenter’s personal experience of the interplay between reported decisions and private settlement in post-earthquake Christchurch through her work mediating insurance disputes. From a methodological perspective, this research project itself gives rise to issues suitable for discussion at the Law and Society Annual Meeting. These include the challenges in empirical study of judges, working with data collected by the courts and statistical analysis of the legal process in reference to settlement. September 2015 marked the five-year anniversary of the first Christchurch earthquake. There remains widespread dissatisfaction amongst Christchurch residents with the ongoing delays in resolving claims, particularly insurers, and the rebuild process. There will continue to be challenges in Christchurch for years to come, both from as-yet unresolved claims but also because of the possibility of a new wave of claims arising from poor quality repairs. Thus, a final purpose of presenting this paper at the 2016 Meeting is to gain the benefit of other scholarly perspectives and experiences of innovative judging best practice, with a view to strengthening and improving the judicial processes in Christchurch. This poster presents work to date on ground motion simulation validation and inversion for the Canterbury, New Zealand region. Recent developments have focused on the collection of different earthquake sources and the verification of the SPECFEM3D software package in forward and inverse simulations. SPECFEM3D is an open source software package which simulates seismic wave propagation and performs adjoint tomography based upon the spectral-element method. By understanding the predictive and inversion capabilities of SPECFEM3D, the current 3D Canterbury Velocity Model can be iteratively improved to better predict the observed ground motions. This is achieved by minimizing the misfit between observed and simulated ground motions using the built-in optimization algorithm. Figure 1 shows the Canterbury Velocity Model domain considered including the locations of small-to-moderate Mw events [3-4.5], strong motion stations, and ray paths of observed ground motions. The area covered by the ray paths essentially indicates the area of the model which will be most affected by the waveform inversion. The seismic sources used in the ground motion simulations are centroid moment tensor solutions obtained from GeoNet. All earthquake ruptures are modelled as point sources with a Gaussian source time function. The minimum Mw limit is enforced to ensure good signal-to-noise ratio and well constrained source parameters. The maximum Mw limit is enforced to ensure the point source approximation is valid and to minimize off-fault nonlinear effects.
Following the Christchurch earthquake of 22 February 2011 a number of researchers were sent to Christchurch, New Zealand to document the damage to masonry buildings as part of “Project Masonry”. Coordinated by the Universities of Auckland and Adelaide, researchers came from Australia, New Zealand, Canada, Italy, Portugal and the US. The types of masonry investigated were unreinforced clay brick masonry, unreinforced stone masonry, reinforced concrete masonry, residential masonry veneer and churches; masonry infill was not part of this study. This paper focuses on the progress of the unreinforced masonry (URM) component of Project Masonry. To date the research team has completed raw data collection on over 600 URM buildings in the Christchurch area. The results from this study will be extremely relevant to Australian cities since URM buildings in New Zealand are similar to those in Australia.
